wolf, it is very naive on your part to think that you can just walk into a court and receive a subpoena/court order ordering the DTCC/SEC to tell all.
first of all, a trust fund is an extremely private fund and any entity/trust company that manages a trust fund will not tell you anything about it or if it even exists under privacy laws. I doubt a court will even order such a breaking of privacy laws.
secondly, if you do go to court to try and get a court order, these entities will fight you all the way to the appeals court if necessary. It is their job to protect private trust funds regardless who set it up and who it is destined.
thirdly, the $25,000 paid to the lawyer will only be for initial attempts to interview the DTCC, SEC, and any other entity. If you decide to go to court to get a subpoena/court order, you will asked to pay another $25,000 to $50,000. No lawyer these days goes to court for less than $50,000, particularly since he will have an opponent arguing against your subpoena request.
fourthly, you will need a very solid reason for asking the judge to give you a subpoena/court order. You will be asking the judge to override privacy laws and judges just don't do that unless there is a very good reason. A just "shareholders need to know" is not a valid reason.
wolf....it will be interesting to see how you do but do not ever think that you will even get to first base.

Swather,
You are exactly the reason I disdain these boards.. You didn't even clearly read the emails from Mr. Fryar regarding his services. Part of his services are to use the TX 202 Action to obtain subpoenas.. He knows what we seek and expect and it will be crystal clear in our contract..
There will be NO internet board messages or posters that distract or delay us any longer..
Any information that I am privy to at this point goes directly to Mr. Fryar, and I invite the rest of the shareholders to do the same..

I don't think for one minute that Jerry intends to hide info from the shareholders .. at least not information that can be shared. I'm sure the deeper we get into this, there will be SOME info that will need to be kept quiet until the appropriate time. (You don't play poker and win by showing your hand until its time). One thing I'm 100% confident about is the fact that through this avenue, we will ultimately get to the truth. I believe that Jerry and the more than 100 shareholders who have joined forces want more than anything, for us ALL to get the truth. Pixie

Again, a little common sense instead of ridiculous comments goes a long way.
What REAL information, proof etc have we gotten from Hodges? NONE. Not even the plaintiffs could share in information. They were never given proof... not even the tiniest bit to where they could be confident in what they were doing. The best they got was and is still, rumors. These rumors get passed around.. dates come and go and in the mean time, people are losing houses, marriages are falling apart, people are dying.
In the case of Atty Fryar... everyone is in complete understanding information will be shared. The only info that may NOT be shared right away would be sensitive info that may be needed.
Please people, think about it...there are many people on these boards who do NOT have our best interest at heart. Those participating on the dark side will be wanting to know what we know and what proof our attorney has. Should we put it all out there so they can run for the hills or cover their tracks?
There is a BIG difference in what Attorney Fryar's purpose is for the shareholders and what Hodges' purpose is.

And just to be clear, Jerry has always wanted transparency. I'm sure that everyone will be relieved that SOMEONE is doing SOMETHING and we as shareholders will benefit.
I'm just curious how long everyone is willing to sit here day after day, listen to the rumors, stories, this guru, that guru...this week, next week...packets..... on and on.
Can we go back 6 months ago and read the bs??? Did we think we would be here today? Are you people willing to be here 6 months from now? A year?
Evidently, some of you are. And the REALLY sad part is... not only will you be here, but you wouldn't know anymore than you do today. I would be willing to bet that Fryar learns more in 2 months than everyone here has in YEARS. It won't be from his work alone.... but from the hundred or more shareholders aiding in the process through the things they contribute as well.
There are some pretty smart shareholders who have been saving and documenting things all along. Many have different pieces to this CMKX puzzle... the more pieces get put together, we can begin to see the picture.. and it's not too pretty. Fryar will get what we can't and give us a voice.

It was humor lighten up. I am just as pissed as the next person. I have lost a home, a truck, had struggles in my marriage, went from making 6 figures to making peanuts and the list goes on. I will meet with the attorney as soon as possible because I am exactly 12.93 miles from him. I have already told Mr. Jerry I would be more than glad to meet with him. I am sending my information to Mr. Jerry so he can inform the attorney who I am before I visit him. Sorry to ruffle your feathers. The new attorney can't get back in town for me fast enough to meet him. I will from here on out.
