Anything from U.S. Department of Justice today..? Yes, just got two emails from the DOJ but I'm not able to access my account to read the update until I get to my office. Perhaps someone else will post the update. It now lists the case as against all players except Casavant and Bagley (because they've died)...but also Edwards and Vissokovsky are no longer listed. pr Make that three email notifications...another just popped into my inbox.

Re: United States v. Defendant(s) Melissa Spooner, Jeffrey Turino, James Kinney, Ginger Gutierrez, Brian Dvorak Case Number 2004R01639 and Court Docket Number 09-CR-00132 Dear XXXXXX: The enclosed information is provided by the United States Department of Justice Victim Notification System (VNS). As a victim witness professional with the United States Attorney's Office, my role is to assist you with information and services during the prosecution of this case. I am contacting you because you were identified by law enforcement as a victim during the investigation of the above criminal case. The defense attorneys requested a new trial date to give them time to prepare for trial. The government did not object to the request because new government attorneys have been assigned to case and they also need some additional time to prepare for trial. The status hearing previously scheduled for defendant(s) Brian Dvorak, Ginger Gutierrez, James Kinney, Jeffrey Turino, Melissa Spooner on August 6, 2014, 09:00 AM at LV Courtroom 6D, Lloyd D. George U.S. Courthouse, 333 Las Vegas Blvd South, Las Vegas, NV 89101 has been rescheduled by the court. VNS will continue to provide you with updated case scheduling and event information.
A status hearing is scheduled before Judge Jennifer Dorsey for December 31, 2014, 09:00 AM at LV Courtroom 6D, Lloyd D. George U.S. Courthouse, 333 Las Vegas Blvd South, Las Vegas, NV 89101 for defendant(s) Brian Dvorak, Ginger Gutierrez, James Kinney, Jeffrey Turino, Melissa Spooner. The purpose of this hearing is to determine if there are issues that the Court needs to address and to schedule any necessary future court dates.

A trial is scheduled before Judge Jennifer Dorsey on January 6, 2015, 09:00 AM at LV Courtroom 6D, Lloyd D. George U.S. Courthouse, 333 Las Vegas Blvd South, Las Vegas, NV 89101 for the case which involves defendant(s) Brian Dvorak, Ginger Gutierrez, James Kinney, Jeffrey Turino, Melissa Spooner.
Please be aware that many criminal cases are resolved by a plea agreement between the United States Attorney's Office and the defendant. You should also know that it is not unusual for a defendant to seek to negotiate a plea agreement shortly before a trial is scheduled to begin. Plea agreements can be made at any time and as late as the morning of trial, leaving little or no opportunity to provide notice to you of the date and time of the plea hearing. If the court schedules a plea hearing in this case, we will use our best efforts to notify you of available information as soon as practicable. If you want to inform the prosecutor of your views regarding potential plea agreements, or any other aspect of the case, please contact the prosecutor assigned to this case or me. Unless you have received a subpoena to attend as a witness in this matter, your attendance is not required. Because of the Court's schedule, hearing dates could change on very short notice. If you plan on attending, you may want to call the VNS Call Center or check the web site to confirm the date and time. So let's review:
The sentencing hearing for Mitchell (who admitted guilt) was moved from July to November 17, 9am this year.
The hearing for Dvorak, Gutierrez, Kinney, Turino and Spooner was moved from 8/6/14 to a time yet to be determined.
The trial for Dvorak, Gutierrez, Kinney, Turino and Spooner was moved from 8/12/14 to a time yet to be determined.
A trial for Gutierrez, Kinney, Turino and Spooner is scheduled for January 6, 2015.
No mention of Edwards or Vissokovsky.
Probably a separate trial for Edwards when he gets here.
Vissokovsky is unknown.
No trial for Casavant and Bagley who have "died."
One trial for the other 5 defendants because they all agreed to a new date, so that likely won't be split into separate trials, even though Turino wants a speedier trial and Gutierrez wanted a trial in Spring 2015, but that won't happen now.
--
10 years to prosecute this.

Thanks for the update PR.
Even when you think they are completely out of excuses...... They always manage to invent new news. Coincidences?? IMO....Seems deliberate. Like they have not had enough time to prepare....... yeah right?? Just a ploy to avoid public visibility??
Hopefully, your previous thought, will prove to have some punch. Your thought .... a reply to this remark posted by diamondcg

Your thought .... a reply to this remark posted by diamondcg SINGLE I appreciate that. But I look at the list of defendants and think...plea bargains and/or disgorgements might not amount to much. Take note of the criminal record for one of them and that provides the impetus to bring RICO into the case. Just the same, its all odd. Ten years plus to prosecute this. Puzzling. Disappointing. Telling. I'm hanging in here like a loose tooth, but there are days its pretty wobbly. pr

Port, I really do have a reply to your post above. But due to unforseen "Excuses", I do believe that I am entitled to request the "need for some additional time to prepare". The date today is August 2014..... I am requesting a delay until August 2015 to respond. Is the motion ..."Granted" or "Denied ?? I may or may not be "Prepared" at that time! Thank you SINGLE
