If most investors look on their trading statments, they will see that even the SEC was making money off our trades. Might not be all that much, but you still took money from the investor. We should give credit to the DTC as they took extraordinary step of requiring their “participants” (brokers) to remove all of their remaining CMKX shares from their treasury.
Don’t buyer’s of certificate’s have to pay real money for what they think is real stock’s in companies.. Some people have the nerve to blame the shareholder’s for buying into stock’s they think have a great chance to make some money and although the vast majority of short sales are legal, abusive short sale practices are illegal. How many times Wall Street crooks have quietly agreed to pay penalties .
Folks you all can say what you want, along with the SEC, DTCC, AND MM’S. NSS is a big problem, and it will not go away. I think that soon, people will start to see that the market is not as safe as everyone thinks it is.
Why did ex-SEC lawyer Roger Glen hired by Urban raise the AS? The greedy crooked market makers & brokers got so fat at the table they couldn’t get out the door. Why would an ex-FBI agent named Robert Mahue be on the board of directors of CMKM Diamonds? Was to catch those fat greedy market makers & brokers they locked them in with a cert pull.
They are not getting away from the NAKED SHORT SELLING that took place with this PINKY " CMKX ".
WE SHAREHOLDERS waited so long to see this come out.

I thought it was interesting that the same day Leslie filed the Complaint: ~ Urban called Leslie ~ Leslie emailed the documents ~ Urban signed and faxed back the acknowledgment
Looks like Urban was “scared” that first day and his emotions switched to not taking this matter serious.
Will be interesting to see how Urban reacts when he's indicted!

So defaulting really imo is not much different. Sec would of had the same ending with him and this way he is spared the circus.
I have also heard that SEC wants all the defendands to go out quietly.. certainly Urban has done that.
And imo he does have a lawyer.. he is choosing to have it this way. Anything Urban would ever say .. they wanted to use against him.
Default judgment is a binding judgment in favor of the plaintiff when the defendant has not responded to a summons or has failed to appear before a court.
In a civil trial involving damages, a default judgment will enter the amount of damages pled in the original complaint. If proof of damages is required, the court may schedule another hearing on that issue.
A defendant can have a default judgment vacated, or set aside, by filing a motion, after the judgment is entered, by showing of a proper excuse

You posted: "I think we would all agree that if shareholders are to receive what would be considered an off the wall per share settlement..ie let's use the famous .54 cents a share which would approach $380 bill., it could only be extracted from the "shadow (derivative and other fuzzy dice financial instruments) banking system). I never believed it could be possible until I began investigating the MASSIVE amounts of money controlled, transacted and PROFITED through these off balance sheet GREED MOTIVATED smoke and mirror global TRADES and SWAPS."
First of all, nothing can be 'extracted' from the banking system, especially not derivatives b/c there is nothing shadowy or 'fuzzy' about them. They are contractual obligations between two parties. It's just like a stock. One gains, one loses based on the performance of the underlying asset. Do you think all the shareholders of any well performing stock would surrender their 'fuzzy' gains so the money could be transferred to cmkx shareholders? Their performance has nothing to do with CMKX.
Thanks.
oaks DIAMOND JEDI Re: Oaks - Derivatives. « Reply #10 Today at 9:09am »
Hi Clay...
I am not saying this happened and I see it only as a possibility if one is to believe CMKX shareholders are going to receive some massive distribution. Personally, I prefer to remain very conservative in my expectations. I merely present the thoughts for consideration to bring about discussion and debate.
As far as my reference to "fuzzy"...how many people have ever heard of the "shadow banking system", if they are not in the business? It is shadow because it is very complex, it is for the most part global and allows for the movement of huge amounts of funds, even if as you say it is transacted between 2 parties. For the most part these offshoot financial instruments were designed to maximize the greed factor and it is one of the major reasons the US has found itself in this financial meltdown and it is now effecting Britain and other countries around the world.
The regulatory bodies have proven how inept they were over the past number of years and are really scrambling these past few months to get a handle on this.
Have a great day.

Late Tuesday, the SEC said the extended order will be in effect until 11:59 p.m. ET on August 12, and will not be further extended. According to the SEC, the decision to extend the order for a second 10-day period, in addition to furthering the purposes of the original order, will permit the Commission staff to collect and analyze additional data on the impact and effect of the order's provisions. Following expiration of the extended order, the SEC will proceed immediately to consideration of rulemaking which would become effective after public notice and comment. The purpose of the rulemaking is to provide additional protections against abusive naked short selling in the broader market, while allowing the legitimate short selling essential to efficient, highly liquid markets. The SEC’s order requires short sellers in the securities of the designated institutions to arrange to borrow the securities at the time of sale so that the buyers will receive the stock they purchased on time. Selling short without borrowing the stock to be sold, and failing to deliver it, is called naked short selling.
