Via Manny who attended the hearing.
The MTD was neither denied nor approved...it was amended for an additional 45 days so that both sides can provide more facts.
Al told Manny that he does NOT expect that this to go that long at all.
Manny said the judge listened very intently to everything Al had to say. He literally put on a seminar for all the back-story of CMKX and the travesty dealt the shareholders. When he brought up Robert Maheu the judge stopped him and asked if it was one and the same Maheu...and Al replied it was.
The attorney for the SEC was woefully unprepared according to Manny...and afterwards Al concurred. He had NO idea what Al was speaking of. When the subject of the Bivens was brought up, the judge queried Al about whether he was suing the entire SEC or just the commissioners individually. Al explained it was just the commissioners and then Al mentioned the issue of "sovereign immunity" the SEC attorney didn't even know what it meant.
In short:
Manny said Al was incredibly informative and the judge took every word in very carefully.
The attorney for the SEC was clearly not able to keep up, nor was he anywhere near as informed or prepared.
Al told Manny afterward he wishes the motion would have been denied but based on the preponderance of evidence he presented...he does NOT expect this to ever go the additional 45 days.

Basically everybody can throw out the conspiracy theory of the SEC and AH working behind the scenes to get this dismissed, and trying to make the SEC look like the good guys to get this dismissed. Man, I even thought that to be the case.
Seems clear to me that AH wants to fight and bring everything to the surface, if the funds are not released.

thanks for posting... very interesting... love how the SEC wasn't prepared... all this proves many of the go2guy types wrong (imo)... also kinda proves the "it's over/scripted" (which I was open to) theories wrong (imo)... looks like this is just a straight up battle (imo).

So am I assuming right? That the Know-it-alls , who so vehemently insisted that AL Hodges would not have a chance to amend or provide additional facts.....Those that insisted that it was just a matter of protocol & that the Tentative ruling, be replaced by a final ruling, would definitely be signed "pronto", in favor of the defendants .......
