It's too early to talk about 'spinning' anything or to start whining. Everyone knew this was coming. We'll see what happens. Your right! And I agree!!!

We discussed that the DOJ would be filing another MTD from the get go. This isn't the time to be negative. Wait for Mr. Hodges response, and then the judges ruling. Well said noble.

GOB, What is the due date on Hodges' next response.. can't find it..any idea.. J WB wolfbela, You mean Al will have to respond to this SEC's MTD ?? i thought, he can no longer show any evidence or file anything else ? I might be wrong, but some of my friend, they aren't complete lawyer yet, they told me that this MTD will be accepted with close eyes... please tell me if Al has to respond to this MTD, cause if he has 1 more chance, than we shouldn't think negative about Al TIA 007

Diamond,
According to GOB.. that's why I asked him.. I didn't see if either.. He says there is an opportunity for Hodges to rebut this filing.
Waiting on GOB.. I didn't see a date in the court schedule. I thought this was the last event before the judge ruled...

I guess it is Nov. 12, as per bjenkins in another thread.. sorry I missed that. Is that contingent upon the judge letting Hodges respond or it is mandatory..
Very vague...
If this was perhaps a setup all the time.. They are going to milk it, the legal process, to the end to negotiate this out..

It must be over. We have to be getting the news now this week, maybe tonight. This is D-day now. But we all expected this. The next court date is 10/16, isn't it? Don't think court will be convening on a Saturday...

Wolf:
If I'm not mistaken, Al has to be given the opportunity to address a motion to dismiss his filing.

Last time he had 30 days to respond. I assume he has the same now.

GOB,
I just don't remember seeing it in the revised schedule of court dates that both sides agreed on.. Last thing I remember was this filing by DOJ/SEC and then a Jan. date for the judge to rule.. I have to go back and look.. or if someone knows definitively..
I guess it doesn't really matter anyway..

So, we may see nothing until then. But, I don't personally think that would be a wise choice this time around.
