When Hodges applied for an extension, the settlement talks were extraneous to his case. IOW.. wasnt Hodges in settlement talks. He stated that if this was successful, this case would be moot. No reason for the SEC lawyer to object. Defendants are just fine with extensions ... they have nothing to lose. Also remember that the lawyer for the sec group was on vacation. If anything, by now, we should all be well versed in how the legal process is slower than molasses. We also have to remember, it was a Lawyer who agreed to the Extention... He had to have read it.. I'm sure if this goes the next step in court, the judge will comment on it..

So now Dec 5th is the next date? Funny a year ago AH was overheard on the steps of the courthouse with his now infamous "if I were a betting man" quote. There should be no need to wait till the 12/5 for his filing as it should already be done considering it was supposed to be filed a while ago before the this stay motion was filed. To h*ll with the negotiations stuff, they aren't negotiating they are stalling, file now and tell them you should have listened!

yep another month we have too wait.. was it not July when Big Al asked for a Delay in filing his Brief??? remember?? he said he had ALL of the sudden info that this was being settled and it would not serve either party well for him too file the brief?? then what, well the SEC stepped in and Al seemed soo shocked, well why the hell did he not file it back in July?? so now we are back too square one as AL has too file in DEC, the same info that all th gurus say the world cannot afford too see. i am sorry, but none of it makes any sense, and put that together with the nonsense in Tyler and i dont believe anyone has the shareholders best interest in there sights..

The funds were swept into the same stipultions as the WGSF. The SEC indivduals named in the Bivens Law Suit are named because of their involvement with the funds.

The Federal Rules of Appellate Procedure do not allow the introduction of new evidence, in fact, the litigation never entered the Discovery phase, accordingly, no evidence was ever exchanged with the Defendants. All that happens on December 5th is Al files his brief. Defendants have the right to respond, and if they do, Al may reply. Once all papers are deemed submitted, the court decides, which may take days, weeks or months. Have a nice weekend."
