Molly White, a senior trial counsel for the agency, said Monday the signature on a document essentially confirming Casavant is aware of the charges against himSEC was in contact with Casavant Friday and they have his ."The notice of waiver basically subjects him to the jurisdiction of the court," White said. "In essence what he's saying is that in lieu of us serving him with process, he basically waives the requirement that he be formally served." Last Wednesday, the SEC announced it was charging 11 individuals and three companies, alleging they conspired to illegally issue and sell unregistered stock in a diamond and gold mining company. The SEC said as many as 40,000 investors in the U.S. may have invested in the scheme. It didn't take long for Casavant, whom the SEC alleges has lived large in Las Vegas for most of this decade, to contact the American regulator of stock markets Friday and agree to sign the waiver. "He reached us by telephone and he faxed that in by Friday afternoon," White said.Asked if Casavant told the SEC where he was, White said she could not comment. However, when asked if it was in Canada, the SEC lawyer said "we believe he is in Canada."Casavant and his American cohorts are alleged to have continuously flooded the market with shares of a mining company known as CMKM. The shares, which once had a "value" of one-hundredth of a penny, eventually were being pedaled for one-thousandth of a penny on the largely unregulated U.S. over-the-counter stock market known as the "pink sheets" exchange. The connection to reality for CMKM was the known fact there are many diamond-bearing kimberlite pipes under the Fort a la Corne forest and in the Smeaton farm district. One such kimberlite, which was highlighted in CMKM press releases, was called the "Carolyn Pipe" after Casavant's wife. CMKM eventually had to acknowledge. However, the kimberlite was not a discovery of CMKM, but had been logged by another company as early as 1996, somethingWhile Casavant and his cohorts promoted CMKM stock at drag races and other auto events throughout the U.S., the company did once have some actual business connections with Saskatchewan-based junior mining companies. At one point in March 2004, CMKM issued a news release it had acquired a 25 per cent interest in 27 mineral claims covering 22,447 acres near Smeaton from United Carina Resources Corp. and Consolidated Pine Channel Gold Corp. Eric Wray, who has taken over as president of these two companies, which are now known as Star Uranium Corp. and United Uranium Corp., said the two TSX Venture companies, plus Shane Resources Inc., intend to do work again on diamond exploration this summer. Wray said Monday Casavant has "nothing to do" with the two successor companies to United Carina and Consolidated Pine Channel.Any rights CMKM once had for Saskatchewan mineral land claims reverted back to the province for actual lack of work done on the claims, Wray said."The Carolyn Pipe is ours right now," he said. "That's been restaked since those days. It went back to the province and somebody restaked and we got it back." Wray said he isn't aware of all the details of what kind of joint venture arrangement the companies had with CMKM and former United Carina and Consolidated Pine Channel CEO Rick Walker, now retired, might have answers. Walker could not be reached for comment. Wray said he takes calls from people from Minnesota or Florida about once a week looking for news about CMKM. "Some of them believe they are going to get their money back," he said.Meanwhile, a spokesperson for the one company actually spending tens of millions on Saskatchewan diamonds said the company doesn't believe the bizarre story of CMKM, which may have issued 700 billion shares in its history, has hurt the province's diamond industry. Joe Dixon of Shore Gold said there has really been "no effect" due to the CMKM scandal. Shore, with partner Newmont Gold, is spending $108 million in 2008 on two side-by-side diamond exploration projects in Fort a la Corne.
