I am a student of history. Professionally. I have written 15 books in six languages, and have studied it all my life. I think there is something monumentally large afoot, and I do not believe it is just a banking crisis, or a mortgage crisis, or a credit crisis. Yes these exist, but they are merely single facets on a very large gemstone that is only now coming into sharper focus.
Something of historic proportions is happening. I can sense it because I know how it feels, smells, what it looks like, and how people react to it. Yes, a perfect storm may be brewing, but there is something happening within our country that has been evolving for about ten - fifteen years. The pace has dramatically quickened in the past two.
We demand and then codify into law the requirement that our banks make massive loans to people we know they can never pay back. Why?
We learn that the Federal Reserve, which has little or no real oversight by anyone, has 'loaned' two trillion dollars (that is $2,000,000,000,000) over the past few months, but will not tell us to whom, or why, or disclose the terms. That is our money. Yours and mine. And that is three times the $700B we all argued about so strenuously just this past September. Who has this money? Why do they have it? Why are the terms unavailable to us? Who asked for it? Who authorized it? I thought this was a government of 'we the people', who loaned our powers to our elected leaders.. Apparently not.
We have spent two or more decades intentionally de-industrializing our economy. Why? We have intentionally dumbed down our schools, ignored our history, and we no longer teach our founding documents, showing why we are exceptional and why we are worth preserving. Students by and large cannot write, think critically, read, or articulate. Parents are not revolting, teachers are not picketing, and school boards continue to back mediocrity. Why?
We have now established the precedent of protesting every close election (now violently in California over a proposition that is so 'controversial' that it wants marriage to remain between one man and one woman!). Did you ever think such a thing possible just a decade ago? We have corrupted our sacred political process by allowing unelected judges to write laws that radically change our way of life, and then allow mainstream Marxist groups like ACORN and others to turn our voting system into a banana republic. To what purpose?
Now our mortgage industry is collapsing, housing prices are in free fall, major industries are failing, our banking system is on the verge of collapse, Social Security is nearly bankrupt, as is Medicare and our entire government, and our education system is worse than a joke. (I teach college and know precisely what I am talking about.) The list is staggering in its length, breadth, and depth. It is potentially 1929 x ten. And we are at war with an enemy we cannot name for fear of offending people of the same religion, an enemy who cannot wait to slit the throats of your children if they have the opportunity to do so.
Now we have elected President a man no one knows anything about, who has never run so much as a Dairy Queen, let alone a town as big as Wasilla , Alaska . All of his associations and alliances are with real radicals in their chosen fields of employment, and everything we learn about him, drip by drip, is unsettling, if not downright scary. Surely you have heard him speak about his idea to create and fund a 'mandatory civilian defense force' stronger than our military for use inside our borders. No? Oh, of course. The media would never play that for you over and over, and then demand he explain it. Sarah Palin's pregnant daughter and $150,000 wardrobe is more important to the media.
Mr. Obama's winning platform can be boiled down to one word: change. Why?
I have never been so afraid for my country and for my children as I am now! This man campaigned on bringing people together, something he has never, ever done in his professional life. In my assessment, Obama will divide us along philosophical lines, push us apart, and then try to realign the pieces into a new and different power structure. Change is indeed coming. And when it comes, you will never see the same nation again.
And that is only the beginning.
I thought I would never be able to experience what the ordinary, moral German felt in the mid-1930s. In those times, the savior was a former smooth-talking rabble-rouser from the streets, about whom the average German knew next to nothing. What they did know was that he was associated with groups that shouted, shoved, and pushed around people with whom they disagreed. He edged his way onto the political stage through great oratoryand promises. Economic times were tough, people were losing jobs, and he was a great speaker. And he smiled and waved a lot. And people, even newspapers, were afraid to speak out for fear that his 'brown shirts' would bully them into submission. And then, he was duly elected to office as full-throttled economic crisis was at hand [the Great Depression]. Slowly but surely he seized the controls of government power, department-by-department,person-by-person, bureaucracy-by-bureaucracy. The kids joined a Youth Movement in his name, where they were taught what to think. How did he get the people on his side? He did it promising jobs to the jobless, money to the moneyless, and goodies for the military-industrial complex. He did it by indoctrinating the children, advocating gun control, health care for all, better wages, better jobs, and promising to re-instill pride once again in their country, across Europe , and around the world.
He did it with a compliant media. Did you know that? And he did this all in the name of justice and ..... change. And the people surely got what they voted for. (Look it up if you think I am exaggerating.)
Read your history books. Many people objected in 1933 and were shouted down, called names, laughed at, and made fun of. When Winston Churchill pointed out the obvious in the late 1930s while seated in the House of Lords in England (he was not yet Prime Minister), he was booed into his seat and called a crazy troublemaker. He was right, though.
Don't forget that Germany was the most educated, cultured country in Europe . It was full of music, art, museums, hospitals, laboratories, and universities. And in less than six years --- a shorter time span than just two terms of the U. S. presidency --- it was rounding up its own citizens, killing others, abrogating its laws, turning children against parents, and neighbors against neighbors. All with the best of intentions, of course. The road to hell is paved with them.
As a practical thinker, one not overly prone to emotional decisions, I have a choice: I can either believe what the objective pieces of evidence tell me (even if they make me cringe with disgust); I can believe what history is shouting to me from across the chasm of seven decades; or I can hope I am wrong by closing my eyes, having another latte, and ignoring what is transpiring around me.
Some people scoff at me, others laugh, or think I am foolish, naive, or both. Perhaps I am. But I have never been afraid to look people in the eye and tell them exactly what I believe, and why I believe it.
I pray I am wrong. I do not think I am.

Obama’s White House is Falling Down By Daniel Greenfield Thursday, June 11, 2009 In the sixth month of his presidency, Obama has turned an economic downturn into an economic disaster, taking over and trashing entire companies, and driving the nation deep into deficit spending expected to pass 10 trillion dollars. Abroad, Obama seems to have no other mode except to continue on with his endless campaign, confusing speechmaking with diplomacy. It is natural enough that Obama, who built his entire campaign on high profile public speeches reported on by an adoring press, understands how to do nothing else but that. Ego driven photo op appearances and clueless treatment of foreign dignitaries While the press is still chewing over Obama’s Cairo speech, this celebrity style coverage ignores the fact that Obama’s endless world tour is not actually accomplishing anything. Instead his combination of ego driven photo op appearances and clueless treatment of foreign dignitaries have alienated many of America’s traditional allies. Those who aren’t being quietly angry at Obama, like Brown, Merkel or Netanyahu, instead think of him as as absurdly lightweight, as Sarkozy, King Abdullah or Putin do. While his officials carry out their dirty economic deeds, Obama responds to any and every crisis as if it were a Mickey Rooney and Judy Garland musical, with a cry of, “Let’s put on a show.” Thus far Obama has put on “shows” across America, Europe and the Middle East. And what the adoring media coverage neglects to cover, is that Obama’s shows have solved absolutely nothing. They have served only as high profile entertainment. Neither alienating America’s traditional allies, through a combination of arrogant bullying and ignorance, nor appeasing America’s enemies, has yielded any actual results. Nor does it seem likely to. Islamic terrorism is not going anywhere, neither are the nuclear threats from North Korea and Iran. While Obama keeps smiling, the global situation keeps growing more grim. At home, if Obama was elected as depression era entertainment, the charm of his smiles and his constant appearances on magazine covers appear to be wearing thin on the American public. Despite the shrill attacks on Rush Limbaugh or the Republican Enemy of the Weak-- the Democratic party of 2009, is polling a lot like the Republican party of 2008. The Democrats have suddenly become the incumbents, and the only accomplishment they can point to is lavish deficit spending, often on behalf of the very same corporations and causes they once postured against.
The European Union Parliament’s swing to the right cannot be credited to Obama, though doubtlessly some European voters seeing socialist economic crisis management on display in the world’s richest country decided they wanted none of it, but it is part of a general turning against federalism. And Obama’s entire program is dependent on heavily entrenching federalism at the expense of individual and state’s rights. Yet that is precisely his achilles heel with independent voters who are polling against more taxes and expanded government. And no amount of speeches by Obama can wish away his 18 czars or the national debt he has foisted on generation after generation of the American people.
That leaves Obama with a choice between socialism and the independent voter. And thus far he has chosen socialism. Obama’s tactic of hijacking Bush Administration era policies on the economy and the War on Terror, and exploiting them as trojan horses to promote his own agenda, have left him coping with a backlash from his own party, as well as general Republican opposition.
His Czars are meant to function as the bones in an executive infrastructure accountable to no one, but a lack of accountability isn’t just another word for tyranny, but for incompetence. A functional chain of command is accountable at multiple levels if it is to function effectively. Obama’s White House by contrast is in a state of over-organized chaos, the sort of organized disorganization that undisciplined egotistical leftists naturally create for themselves, complete with multiple overlapping levels of authority and no one in charge but the man at the top, who’s too busy doing other things to actually be in charge. Dennis Blair as National Intelligence, who collaborated with the Muslim genocide of Christians in East Timor, trying to muscle out the CIA to create his own intelligence network, is typical of the kind of chaos being spawned by every chief in an expanding government bureaucracy working to make sure that all the Indians answer to him. Similarly the National Security Council wrestling with the State Department, highlighted by Samantha Power getting her own specially created NSC position to butt heads with Secretary of State Hillary Clinton, illustrates the state of conflict and chaos in American foreign affairs. A state of chaos so pervasive that incompetence has now become commonplace, and no one can even be found to double check the spelling of a Russian word that is meant to be the theme of American’s diplomatic reconstruction with Russia, or to pick out a gift for the visiting British Prime Minister. Meanwhile on the economy, Obama exploited the ongoing bailouts, transforming them from bailouts into takeovers meant to shift the balance of power in what had been a democracy and socially engineer not only corporations, but the lives of ordinary Americans. But the public’s patience with corporate bailouts is at an end, most Americans were never happy with them to begin with, and want them to end. The death of Chrysler at the hands of Fiat and the UAW might look like a victory in the union ranks, but it doesn’t play too well outside Detroit. And tacking on CAFE standards that will kill the pickup truck and the SUV will badly erode Obama in the swing states, if exploited properly in 2010 and 2012. Despite the constant media barrage, orchestrated out of the White House, the public is growing disenchanted with the performance of Obama and the Democrats. With unemployment booming and the economy dropping, the jobs aren’t there and the spending is out of control. Republicans today are polling better on ethics and the economy, than the Democrats are. That shows a trend which is likely to register in the mid-term elections in 2010, in the same way that the EU parliamentary elections served as a shock to the system.
In the opposition, Republicans are free to embrace the rhetoric of change, to champion reform and push libertarian ideas about the size and scope of government. In turn all Obama has is his celebrity fueled media spectacle world tour. A charade now serving as a parallel to the depression era entertainment that functioned as escapism in a dour time. But before long, it may be Obama that the American public will want to escape from. A shallow, manipulative and egotistical amateur who is in over his head Obama has tried to play Lincoln, Reagan, JFK and FDR-- but in the end he can only play himself, a shallow, manipulative and egotistical amateur who is in over his head, and trying to drag the country down with him. Obama’s White House is falling down and while the flashbulbs are still glittering and the parties are going on in D.C. and around the world, Obama and the Democratic Congress may be headed for a recession of their own.

Mr. Hormats, 66, will be under secretary of state for economic, energy and agricultural affairs. # 27Curt Okay, folks, here’s where the rubber meets the road, the pedal meets the metal, the hammer meets the anvil: Ms. Geller begins her commentary with the reassuring words “I am a student of history. Professionally, I have written 15 books in six languages, and have studied history all my life.” So far, so good. So she’s well-versed and qualified in the subject of history. I’m already feeling the onset of warm cuddlies. And as I read through her commentary, I’m finding myself agreeing with most of her observations and conclusions. Again, so far, so good. After all, I, too, lay claim to being a student of history. Then she gets to the line that reads “And then he (Adolf Hitler) was duly elected to office….” Okay, Ms. HistWiz, let’s make sure we’re reading that correctly: Adolf Hitler was “duly elected to office”… presumably meaning the office of German Chancellor. Now here’s your history lesson du jour, Ms. HistWiz: Adolf Hitler was never elected to ANY national office… in Germany, in Austria, in Mauritania, in Patagonia… nowhere. He was never, ever elected to any elective office whatsoever, outside of inner-Nazi-party (i.e., NSDAP) elections. Never. Repeat, NEVER. As his (National Socialist party) numbers were collapsing in the national polls (in 1928, 1930 and again in 1932. The office of Reichkanzler (Reich Chancellor) was serendipitously handed to him on a silver platter by the geriatric-and-failing Paul von Hindenburg on Monday, 30 January, 1933; the strategy was that the elder statesman and his cabinet would be able to control and manipulate the noisy Bohemian rabble-rouser. She goes on to say “Slowly but surely he (Hitler) seized the controls of government power, department by department, person by person, bureaucracy by bureaucracy.” Really? Slowly but surely? So, Ms. HistWiz, I do not need to “Read my history books.” I have in fact already read them. While it appears that the Marxist-Keynsian pipe dream has nightmarishly reached the highest office of governance, Curt is right. If you are going to broadcast a message of purported importance and present yourself a "student" of history....have some idea of what ACTUALLY happened. It might lend some credence to your rant. Wondering if some of those 15 languages are those "spoken" by the faithful while juggling snakes.

Yes, indeed Historic Events are taking place. One is this Supreme court nomination of a Judge who may have been involved in a Federal Bankruptcy fraud scam. One case in particular was brought up by researcher Dr. Richard Cordero. That is the DeLano case, 06-4780-bk, CA2. In simple terms the individual going thru bankruptcy hid over $650,000 in assists from creditors. Judge Sotomayor was involved as she allegedly disallowed discovery requested by creditors of Mr. DeLano. Dr. Cordero has faxed to all Senators a 32 page report on several unsavory matters relating to Judge Sotomayor. One of the reasons for the delay in the vote by the Senate is this controversy.

GOP SENATORS IGNORE SOTOMAYOR'S CRIMINAL ACTIVITIES By: Devvy July 20, 2009 © 2009 - NewsWithViews.com www.newswithviews.com/Devvy/kidd455.htmAs the confirmation hearings of Supreme Court Justice nominee, Sonia Sotomayor, proceeded last week, one man could not understand why not one of the seven Republican senators on the Senate Judiciary Committee would question Sotomayor about her criminal activities. It's understandable no Democrat would ask Sotomayor to explain herself since each and every Democrat in the U.S. Senate is so ethically bankrupt, they would seat Satan on the high court if it would further their agenda. Their only concern for a justice on the highest court in the land is gender and ethnicity; these pusillanimous hucksters go for future votes. The law and truth be d*mned. But, the silence by Sessions, Graham, Coburn and the others is beyond perplexing. Bill O'Reilly remarked last week at the end of the hearings that the Republicans will vote to confirm Sotomayor possibly to "garner favor" with Latino voters for the next election. Sounds like a good excuse as any for their cowardice in not taking Sotomayor to the box on Dr. Cordero's evidence. I first became aware of Dr. Richard Cordero's documentation a week ago. As with any other investigation, one has to spend a great deal of time studying all the evidence and Dr. Cordero has it. It took about nine hours of reading to get through his evidence, i.e., this 236 pages laying out the fraud. This humble man is like so many other Americans who believe in the rule of law, only to find out that some are above the law due to their political clout. In my email exchanges with Dr. Cordero, and when he was a guest on my radio show last week, I could detect no political bias, only a desire to stop the confirmation of Sonia Sotomayor. As with cases involving legal issues, things can get a bit convoluted, but hopefully I can keep it on track here without drowning in minutiae. Dr. Richard Cordero holds a Ph.D. in law from the University of Cambridge in England; a law degree from La Sorbonne in Paris, and earned a Master of Business Administration from the University of Michigan. Dr. Cordero is a member of the bar of the State of New York. For the past 5 years he has been involved in 11 federal bankruptcy cases, which he has appealed from the U.S. Bankruptcy Court, WBNY, to the U.S. District Court, WDNY, to the Court of Appeals, CA2, and to the Supreme Court of the United States. It is because of his cases in the U.S. Bankruptcy Courts that he discovered certain judges are above the law because no one is stopping them. Dr. Cordero plainly and without apology states that Sonia Sotomayor has been a willing participant in a cover-up in concealing assets as part of a judicially run and tolerated bankruptcy fraud scheme. She also lied on the required documentation submitted to the Senate Judiciary Committee. Dr. Cordero's states: "In the DeLano case, 06-4780-bk, Judge Sotomayor, presiding, and her colleagues on a panel of the Court of Appeals, 2nd Circuit (CA2), issued a summary order to protect, not the rule of law, but rather their appointee to a bankruptcy judgeship, Bankruptcy Judge John C. Ninfo, II, WBNY. "He had covered up the concealment of at least $673,657 by the most unlikely of ‘bankrupts’: a 39-year veteran banker who at the time of filing for bankruptcy was and remained employed by a major bank, M&T Bank, precisely as a bankruptcy officer! Both M&T and Mr. DeLano are clients of the law firm, Underberg & Kessler, in which Judge Ninfo was a partner at the time of taking the bench. "The DeLano case was one of the 3,907 open cases, according to PACER, that the trustee in that case, George Reiber, had before Judge Ninfo. "To protect such concealment of assets by a bankruptcy system insider and her bankruptcy appointee, Judge Sotomayor violated discovery rights by denying every single document in all creditor-requests, which would have exposed a judicially run bankruptcy fraud scheme. "Worse yet, by so doing, Judge Sotomayor failed to protect the single most important Constitutional guarantee that a judge, let alone a Supreme Court justice, is required to safeguard: due process of law." These are very serious charges. Does Dr. Cordero have any proof? Yes. Indisputable and every single member of the Senate Judiciary Committee has had this evidence (not speculation) since July 3, 2009. Dr. Cordero spent all last week calling every member of that committee, both Republicans and Democrats to confirm they received the documents. I called several offices (Sessions, Coburn, Franken) to confirm they had these documents. They do. And, yet, not a single question was asked of Sotomayor on any of the evidence presented by Dr. Cordero. Instead, all of them (Coburn, Sessions, Graham, et al) have remained silent. Why? That would be the $64,000 question. One which Dr. Cordero finds perplexing; his own words in an email to me: "This puzzles me greatly, particularly since each of the three acts of wrongdoing that I discussed bears corroboration by either: (1) The Committee's questionnaire; (2) Judge Sotomayor's answers to it and her conduct; (3) The docket of the DeLano case, 06-4780-bk, CA2; and (4) statistics of the Administrative Office of the U.S. Courts on the denial by the 2nd Circuit Judicial Council, of which Judge Sotomayor is a member, of 100% of petitions for review of dismissed judicial misconduct complaints during the 1 Oct 96 - 30 Sep 08 - 12-year period." If you click here, it will take you to the 173 page questionnaire Sotomayor was required to answer and submit to the committee. She had to disclose ALL cases, see Heading: 13 - Judicial Office on page 87. The list is extensive, but no where will you find the DeLano case. A glaring omission that Sotomayor could not possibly have simply forgotten. She did not list it because to do so would expose her participation. Below is Dr. Cordero's research and the facts. If you don't take the time to read the documents you won't have a full and complete understanding of this fraudulent scheme involving federal judges: Click here to read Dr. Cordero's letter to the entire Judiciary Committee. It details Sotomayor's deliberating lying to the committee through omission. The reason was to protect her own criminal activities. Click here for a full accounting of Sotomayor's financial records. Click here to see the complete list of all submissions to the Judiciary Committee by interested parties, special interest groups and the usual groupies. Absent is one document or letter from Dr. Cordero exposing Sotomayor. Why? Again, Dr. Cordero's comments to me: "Something is going on there. But Senator Franken is not part of it because he just arrived in the Senate. For that reason and those pointed above, he is the least likely to feel bound by any understanding among Democrats and Republicans on the Committee not to question Judge Sotomayor on that evidence. If he does, he can achieve what is conceptually so close to his way of thinking as a media personality: He can scoop the other Senators on prime time!" Instead, Franken once again demonstrated he is no more qualified to sit on the Senate Judiciary Committee than Bugs Bunny by reminiscing with Sotomayor about watching Perry Mason on TV. While he is in possession of Dr. Cordero's evidence, Franken chose to ignore it. The Choice: Judge Sotomayor's Ethnicity v. Equal Justice Under Law "Judge Sotomayor's participation in a bankruptcy fraud scheme cover-up: With that attitude, Judge Sotomayor and other colleagues of her decided the DeLano case, which was appealed to the Supreme Court. They ruled in favor of their appointed bankruptcy judge's non-disclosure of the whereabouts of at least $673,657 of the most unlikely of 'bankrupt's': a 39-year veteran banker who at the time of filing for bankruptcy was an M&T Bank bankruptcy officer! The cosmetic hearings are now over and Sotomayor has to be confirmed by the full senate. Sotomayor should be indicted by a grand jury. She should absolutely not be confirmed to the U.S. Supreme Court until a full investigation is undertaken. There's no question all 17 members of the Senate Judiciary Committee are sitting on this evidence. Only a massive outcry by the media and the American people is going to push this to the point where there will be no vote until Sotomayor and the other judges involved are investigated. Time is of the essence It appears Leaky Leahy, Chairman of the Senate Judiciary Committee, suddenly feels an urgency to bring Sotomayor's nomination to a full vote by tomorrow, not weeks from now as would be normal. As with the usurper president, such an action is completely transparent: Get Sotomayor confirmed because possession is nine tenths of the law. Once she's in (like Obama/Soetoro and Hillary Clinton's illegal confirmation), removing her from the bench becomes a thousand times more difficult. Leahy knows the truth about Sotomayor is now out there and full damage control is underway. Thus, the need for a hurry up vote tomorrow. How despicable these people are in their lust for power. How can we deny any longer that Congress is nothing more than outlaws who have zero regard for truth and the law? How will our nation survive if those who take an oath, whether on the bench or in Congress, stomp on the law and trash the U.S. Constitution in their quest for financial or political gain? You know, if you start to think that most of these leaders of the "tax protestor" movement have a screw loose which is rattling around in only half a brain, you only have to look as far as Devvy Kidd for confirmation. Devvy buys into about every far-right-wing conspiracy theory, including that the world is actually illegally controlled by Freemasons. New World Order, United Nations, buying Chinese products -- if it is a stupid theory the odds are good that Devvy has bought into it whole hog. Of course, not having half a brain doesn't mean that you can't cash in like the other tax scam artists. For a mere $24.95 you can get the whole Devvy collection of conspiracy theories and her "proof". But wait! Selling CDs is small pickin's compared to Devvy's other gig, which is endorsing "El Dorado Gold Discount" which deals in gold coins over the internet. At one point, Devvy apparently tried to form the "Wallace Institute" (named after Mel Gibson's character in Braveheart) but was unsuccessful in getting 501(c)(3) charitable status, so that went by the wayside. Devvy's theory regarding taxes is that the 16th Amendment was never properly ratified. Of course, she didn't do any significant research on her own but merely refers to ex-felon and fellow Quatlooser Bill Benson's "The Law That Never Was". In January of 2000, Devvy proclaimed that the Wallace Institute was preparing to file a lawsuit in Oklahoma City to declare the 16th Amendment illegal. The case of course went nowhere. Devvy also has put our flyers declaring the income tax to be "voluntary", although the courts have regularly sanctioned, fined, and convicted those who have raised this ridiculous argument. Devvy has also been implicated in the "We the People" scam, which has had its greatest publicity recently with Lynne Meredith's indictment. We can only hope that Devvy is soon able to spend long hours chatting with her comrade-in-scam. ___________________________ Devvy Kidd 's Claims Exploded Devvy Kidd 's premise is that all federal income tax laws are unconstitutional because the Sixteenth Amendment was not officially ratified, or because the State of Ohio was not properly a state at the time of ratification. This argument has survived over time because proponents mistakenly believe that the courts have refused to address this issue. The Sixteenth Amendment provides that Congress shall have the power to lay and collect taxes on income, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration. U.S. Const. amend. XVI. The Sixteenth Amendment was ratified by forty states, including Ohio, and issued by proclamation in 1913. Shortly thereafter, two other states also ratified the Amendment. Under Article V of the Constitution, only three-fourths of the states are needed to ratify an Amendment. There were enough states ratifying the Sixteenth Amendment even without Ohio to complete the number needed for ratification. Furthermore, the U.S. Supreme Court upheld the constitutionality of the income tax laws enacted subsequent to ratification of the Sixteenth Amendment in Brushaber v. Union Pacific R.R., 240 U.S. 1 (1916). Since that time, the courts have consistently upheld the constitutionality of the federal income tax. Relevant Case Law: Miller v. United States, 868 F.2d 236, 241 (7 th Cir. 1989) (per curiam) - the court stated, "We find it hard to understand why the long and unbroken line of cases upholding the constitutionality of the sixteenth amendment generally, Brushaber v. Union Pacific Railroad Company . . . and those specifically rejecting the argument advanced in The Law That Never Was, have not persuaded Miller and his compatriots to seek a more effective forum for airing their attack on the federal income tax structure." The court imposed sanctions on them for having advanced a "patently frivolous" position. United States v. Stahl, 792 F.2d 1438, 1441 (9 th Cir. 1986), cert. denied, 479 U.S. 1036 (1987) - stating that "the Secretary of State's certification under authority of Congress that the sixteenth amendment has been ratified by the requisite number of states and has become part of the Constitution is conclusive upon the courts," the court upheld Stahl's conviction for failure to file returns and for making a false statement. Knoblauch v. Commissioner, 749 F.2d 200, 201 (5 th Cir. 1984), cert. denied, 474 U.S. 830 (1986) - the court rejected the contention that the Sixteenth Amendment was not constitutionally adopted as "totally without merit" and imposed monetary sanctions against Knoblauch based on the frivolousness of his appeal. "Every court that has considered this argument has rejected it," the court observed. United States v. Foster, 789 F.2d 457 (7 th Cir.), cert. denied, 479 U.S. 883 (1986) - the court affirmed Foster's conviction for tax evasion, failing to file a return, and filing a false W-4 statement, rejecting his claim that the Sixteenth Amendment was never properly ratified.
