Hole john3339 DIAMOND DIGGER Re: Other Gossip,etc...8/3/09--> « Reply #40 Yesterday at 7:39pm » I'll bet WE won't! Once the SEC posted the archival data of all FTDs, showing CMKX had no FTDs at revocation, I pretty much resigned myself to seeing if the "mining and exploration" play comes to anything. Unless someone posts documentation disproving the SEC's official archival data, it seems plain enough to me there is no current naked short position. Apparently the naked shorts frizz said he could prove, are the shorts he's not wearing. I expect the tyler boys to announce this merger, and at least a 1,000 or 10,000 to 1 reverse split so the AS can become reasonable, like a REAL company. Then I expect the tyler boys, in their merger, to transfer our newly RS shares into the new company one for one-RESTRICTED, so as to not bankrupt the new company before it can get started. (can't have their most valuable asset bailing on the new company) That effectively makes the new shares worth anything only after they decide to let you pay to have them unrestricted - after a bit of more time. In the meantime, they'll probably issue some stock dividends like we got with USCA (restricted) and others (restricted) that now cost more to remove from my account than they're worth. Based on past actions and words, if there's a way for them to screw us, they'll do it in a NY minute. So like I said, I'll bet WE won't be around for another 2 to 3 years. I imagine those who stay on Fantasy Island will continue the cycle of rumor-bust-rumor-bust-rumor-bust ad infinatum. Whew, what a life they must have! john3339 DIAMOND DIGGER Re: POLL: Will the sec shut us down if we trade ag « Reply #5 Today at 6:54am »
In it's present form, the SEC won't reinstate us, or for that matter any new company with as many shares authorized as what CMKX has.
Name me any company trading on any exchange that has an AS of 800 BILLION shares please.
It won't happen , imo.
The share structure has to be corrected. And unfortunately, not trading now, that means any reverse split will not affect the pps, unless and until CMKM Diamonds is able to find some way to get back to trading. the New Company merger as described might be that vehicle, depending upon whether it is already listed (shell) and is reactivated with the merger, or if it's going to be a totally new entity with an IPO.
The share structure is going to have to be realistic and commensurate with the value of the company. and even wonderful core samples won't show actual value, rather, they will show wonderful potential. thus, the AS is going to have to be a lot less than 800 billion shares.
with a PAR value of $.0001, CMKM should have a value of $80 million (based on the AS of 800 billion shares). If you want a PAR value of just a penny, the AS would have to be reduced to 8 billion shares. (a 100:1 RS) A PAR value of $.10 brings the AS to 800 million shares.
If valuation is proved to be $800 million, then the PAR value of the current AS becomes $.001. If valuation is $8 billion, then the PAR comes to a penny per share.
Shore Gold, as advanced as it is in it's bulk sample program, has a market capitalization of just $846 million. (for comparison)
Realism.
and imo john

my69z, so, you think in the final analysis the NSS are going to be let off the hook and the shareholders that never got their certs are SOL?
furthermore, you think the company was never paid for our certs?
if that's the case then it seems to me everyone involved went through helll and high water for a bunch of nothing.
if urban or whoever didn't do anything tricky to trap shorty then who cares about the naked short? why didn't we just keep trading back in 2005? it doesn't seem like we're going to be all that far ahead if/when we resume trading.
now, if urban did buy up all the shares and he did force shorty to pay him something for our shares so they could be certed and urban is going to use some of that money to make us a tender offer then that seems real smart and a dream come true. if it's not that, or something like that, then why did he even bother dragging us through this tragedy for the last four years?

This is what I was told way long ago. It ws stated to me that all of this was relayed to a one time backer of Tyler. :'(It will cost to stay with the New Company. Now begs the question.....what is in it for those board members and those who have dropped out and just may be on the infamous Advisory Board. IMO, tooooo many of those who spoke toooooo loud have just disappeared. Makes me go Hmmmmmm. There has to be something going on that we, the majority, are not privvy to. So we continue to wait for the ax to fall. FALL, it will, just not sure when or how hard. I know that the small shareholders, like me, will be the first ones out. And I sure ain't paying to stay with a company who gives me nothing now. I would have to seriously question the intelligence of any who would. Just my opinion, which I don't express often.

What I hope (not know) is that this is evidence of manuverings leading to finality re who is "bonified" & who is not. IMO, the SEC is looking for a way to cover their dirty tracks so it's hard to separate the real wheat from the real chaff. Is it real or is it Memorex?

i was hoping my69z would be on analyzing that court document. he's the best at that. maybe he'll be on this weekend to provide us with his own unique perspective on the court stuff.

I explained to the duty officer that in the FOIA deposition of Roger Glenn, that Mr Glenn had mentioned a Grand Jury prior to his 2007 deposition. So I asked him, if the GJ was meeting back in 06, does it really take this long for indictments? He said if the case is complicated it can take much longer...ugggg. But I did appreciate his input.
