Jump to msg. # to the SEC, i know you folks monitor all the CMKX boards..........
You can spin this any way you wish, but the facts are known by thousands of CMKX investors..........
If it wasn't for Urban Casavant, you SLUGS would still be stealing your BILLIONS per year from the American Public. Thank God someone with the Brass showed up to Destroy your Corruption.
I laugh at your feeble attempt to take credit

Even family of the SEC unit getting notice of the Madoff fraud put 2Mil. into it. Now they are cryin!
Slugs is a good analogy! We have a lot of them here in the northwest. They leave a slime trail after they have ravaged that which was meant to sustain, they serve no real purpose, and when you pour salt on them (salt of the earth) they begin to disintegrate into nothing.
I'd like to see that happen to an agency that still allows fraud to continue to this day. They can't use the incompetence excuse for long though.
Someone has to serve as "salt of the earth".

Jump to msg. # Just a quick question that has been nagging me...how does the SEC intend to collect any monies from Urban when we (CMKM Diamonds) have a restraining order against all of Urban's assets in the Nevada court...and we are still awaiting the Nevada courts final order of default against Urban after he was served via publication over a year or so ago? Am I wrong on any of the above assumptions?

Doubt the sec ever really tries. In this case, much rather the company gets it than the SEC. They KEEP almost half of these judgements.

Re: NEW JUDGEMENT ON URBAN & ALL OTHERS « Reply #37 Today at 4:09am »
--------------------------------------------------------------------- was reading to days final judgement: this is what I like about it:
Casavant shall not, 18 after offset or reduction of any award of compensatory damages in any Related 19 Investor Action based on Casavant's payment of disgorgement in this action, argue 20 that he is entitled to, nor shall he further benefit by, offset or reduction of such 21 compensatory damages award by the amount of any part of Casavant's payment of 22 a civil penalty in this action ("Penalty Offset")
For purposes of this paragraph, a "Related Case 2:08-cv-00437-LRH-RJJ Document 129 Filed 09103/2009 Page 8 of 8 1 Investor Action" means a private damages action brought against Casavant by or 2 on behalf of one or more investors based on substantially the same facts as alleged 3 in the Complaint in this action
My personal take is:
UC has to pay 3150000 USD disgorgement + 31500000 penalty = 63 000 000 USD for basically selling some 800 000 000 unregistered shares; that should calculate and result into "private damages" of some 0.07875 USD per share; not calculating Edwards etc; if the SEC keeps the penalty amount then we should get at lease half that amount; then: claims go/went into "NewCorp" ( as in "General Settlement" earlier ) ; worked by most likely Shore Gold and/or others etc; therefor possible future royalties;
with this judgement the SEC is home free and we have a reason to receive a disgorgement (Investor Action) and we can move on as Investors still owning our certs; ( considering released "General Settlement" );
IMO
---------
Next one!
from Final Judgment:
The Commission may by motion propose a plan to distribute the Fund 12 subject to the Court's approval. Such a plan may provide that the Fund shall be 13 distributed pursuant to the Fair Fund provisions of Section 308(a) of the Sarbanes14 Oxley Act of2002. Regardless of whether any such Fair Fund distribution is 15 made, amounts ordered to be paid as civil penalties pursuant to this Judgment shall 16 be treated as penalties paid to the government for all purposes, including all tax 17 purposes. To preserve the deterrent effect of the civil penalty, Casavant shall not, 18 after offset or reduction of any award of compensatory damages in any Related 19 Investor Action based on Casavant's payment of disgorgement in this action, argue 20 that he is entitled to, nor shall he further benefit by, offset or reduction of such 21 compensatory damages award by the amount of any part of Casavant's payment of 22 a civil penalty in this action ("Penalty Offset").
what I further like is:
- "including all tax purposes" ok - tax issues out of the way - as in settlements there are no tax liabilities due
and further
- "Casavant shall not - after offset"
after offset - meaning UC faces no further penalty nor prosecution (such as civil nor criminal ); he is not entitled to any participation of upcoming disgorgement; we have known for a long time already that: it is "all for the shareholders"!
- Related Investor Action - what has Frizzel and West / Tyler been doing? Exactly that! No?
Isn't the puzzle coming together here?
IMO

By: gusjarvis 05 Sep 2009, 06:29 PM EDT Rating: Msg. 865071 of 865131 it is sept 5th 2009, exactly five years to the day the sec got the fraud records from the silver state bank
By: gusjarvis 05 Sep 2009, 06:55 PM EDT Rating: Msg. 865081 of 865131 so what happened after sept 5th 2004, what did bob say after the fraud was busted and on the internet, what did he say knowing bill frizzell the bulldog was on the case and already knew of the silver state bank fraud subpoenas as did everyone on the boards. He came on right at the same time as bill, right after the boards heard urban committed fraud through the silver state bank records.
This is what bob said after that:
"Solving problems has been my occupation for many years,"
"Tough assignments are not solved by wishful thinking, but rather by tough action." A new team of securities attorneys has been instructed that their prime assignment is to correct any deficiencies of the past and to cooperate fully with regulatory bodies both in Canada and the United States to minimize the possibility of such deficiencies in the future.”
"Like the SEC, protecting our investors is a primary concern. We have been aggressively gathering the essential information needed to comply with our public disclosure obligations and anticipate working with the SEC to ensure our compliance with all federal regulations,"
"We are not letting these regulatory matters impede our primary focus of creating stockholder value through the mining and development of our mineral assets,"
"When I joined the board one of my prime assignments was to improve corporate compliance. A prime component was to reinstate reporting status, which was efficiently and expeditiously handled by the Stoecklein Law Group,"
"We are extremely appreciative of Stoecklein Law Group's immediate attention to our needs. I have worked with them in the past and they have always exceeded my expectations,".
“When I initially took on the assignment of assisting CMKM with its compliance needs, of primary concern was doing the right thing for the stockholders.”
"I am fully committed to protecting the interests of bona fide CMKM stockholders, including if necessary, bringing appropriate federal or state court actions to ensure the appropriate distribution of the Entourage shares is made.”
“We faced a tremendous number of hurdles, including the trading halt, administrative hearing and let down of numerous professionals. However, with the continued commitment of Urban Casavant and diligent professionalism of Stoecklein Law Group, we are trying to overcome the obstacles of the past and look forward into the future towards distributing value to CMKM's bona fide stockholders.”
"This is a time for the CMKM stockholders to look forward towards the future and forget the past. Working as a united front will allow us to extract all available sources of value for distribution."
