Incredibly, some individuals involved in the scam continued to fraudulently sell stock for years after the company's stock was revoked. A letter signed by an SEC staff attorney and faxed to CMKX transfer agent Helen Bagley on May 26, 2004 requested documents from 1st Global Transfer pertaining to purported mastermind John Edwards, CEO Urban Casavant and others involved in the CMKX scam. A file from Bagley's office notated "These were copies SEC made" clearly shows that the SEC knew about the fraud before the stock ran up 1000% in price, only to drop back down to its original price, costing shareholders tens of millions of dollars in a matter of days. -------------------------------------------------------------------------------- Even though the hired help does not respond to our demands for transparency...even though the SEC has maybe gone out on a limb to publish their archival data showing no naked short position in CMKX...even though the company insiders insist there are no stockpiles of money for shareholders...even though frizz doesn't even mention naked shorts any more...
The company is still alive and apparently making or receiving benefits from deals (claims coming back, the new corp)...and apparently there are operating funds from somewhere (at some cost to the company).
CMKX lives as a corporation. and as long as it does, there is a glimmer of hope....rumor-mongers and hypsters aside.
As long as CMKM Diamonds is a "company", I'll have hope. Tempered...but still present.
There may be efforts to whittle down our optimism through pie-in-the-sky hypes, and crashes of failed predictions, but as long as there's a possibility we might get something official, I'll keep an ember glowing...no thanks to the rumor-mongers and their enablers. It's all self-sustaining now.
Besides, if I tossed my certs, historic precident would dictate that we'd get a payout the very next day! So....let's see where we are come tax time next year.

No I cant prove it just yet but no one can disapprove it with facts either.
But lets start with where would we be with out a huge naked short? Would the same course of action taken place if there wasn't a share problem including the cert pull per Urban and the task force?

You ALL KNOW, whether you admit it or not, that many agencies and people had knowledge of "wrongdoing" and DID NOTHING to help the investors. Those tasked with protecting investors from PONZI SCHEMES, those tasked with monitoring UNUSUAL TRADING ACTIVITIES, those tasked with TRADE SETTLEMENTS and a host of other neglected duties. They ALL failed miserablly at their duties!
Squabble, whine and lie, matters not.
Bottomline is this.... The shareholders of CMKM Diamonds Inc. were totally ignored and considered non-essential investors because CMKX was a pink sheet stock. THAT is a FACT!
And what really iritates me is the side show circus that has been allowed to continually feed upon CMKX'ers on these message boards and in chatrooms. New cons, new pumps and new angles. All the while, under the watchful eyes of regulators.
Who is protecting them?

The shareholders of CMKM Diamonds weren't ignored because they were considered "non-essential" investors. They were ignored because they were already victims. Nothing could be done to save them without creating an even larger group of new victim shareholders.
When the SEC revoked CMKM Diamonds, there was no point in entertaining the complaints of the bagholders who bought into this scam. From a financial perspective, they were already dead. The purpose behind the revocation was to prevent CMKM Diamonds' management and promoters from adding to their victim list.

You know as well as I do, the SEC had NO INTENTION of doing squat over this case. They "ASSUMED" that we would die off and go away. Problem solved...
But we didn't. Nor will we. They, and all others, MUST face that FACT! And they must also face the repercussions for their actions. Or lack of.

First of all, there is a process to revocation. And even a scam outfit like CMKM Diamonds is entitled to due process of the law. If you want to change the process of revocation, that would certainly be something to take up with the SEC and/or Congress. However, there is a reason that the current process involves an initial suspension, followed by a hearing, and then a final revocation. Do you really want the SEC to have the power to arbitrarily revoke the registration of any company they see fit to revoke at any time?
Why should there have been any actions taken against broker/dealers accepting unsolicited orders from customers who want to dump their hard-earned money into a scam?
"Delidog", like Casavant, et al, is also entitled to due process of the law. He didn't become a criminal until he committed the act of selling unregistered securities. You certainly can't have expected the SEC to have known of "Delidog"'s intent prior to the act.
The only repercussions the SEC faces now over the CMKM Diamonds hype comes from a handful of whack-job malcontents who still don't understand how and why they got ripped off. They're pretty used to the crazies by now.

Time will tell. I have a COMPLETE MP3 ARCHIVE SAFEGUARDED that includes MANY CALLS to SEC OFFICIALS. You would be surprised just how they act and what they say when they feel "in charge". I wouldn't be so quick to think they are untouchable. lololol
Justice may seem blind somedays, but when that lady finally figures out where you are, she swings hard!

Luckily for me and a handfull of others, we didn't get burned. We bought, certed, and have held.
Other than that, it has been a "go get'em" story for us.

Our investigation reveals a potentially huge naked short position in at least two of the very companies that have sent us Certs. The certs sent to the Task Force by the brokers represent billions of shares of CMKM stock…It is clear from the Regulation SHO records in conjunction with other sources (ADP, the transfer agent and the DTCC) that huge fails to deliver in this stock currently exist. It would be a breach of the fiduciary duty of the company to distribute these assets to a broker in lieu of its true beneficial owner when there is evidence of known fails to deliver occurring at the same brokerage house."
