Ok. Nobody has asked this. I am just curious. How can the SEC lawyer say the sting was "news to him"? I know this is second hand or third or whatever. How could he not know? Did he not read the lawsuit? Did he not read any of the filings? Did the SEC think this was going to be a homerun open/shut case? How could the SEC lawyer not know any of what Al was talking about? Is this all so truly inconsequential to them not to do a background on their case? Am I missing some vital piece of information? My thoughts exactly.......

txtrainer - Very good question as I have thought he same myself. I think given the O'Quinn case and how he was killed on his way to the final court appearance and then the poisoning of Christopher Story, every precaution ought to be taken by Al Hodges & Associates. IMO I agree. Hodges has to have protection , and serious protection.

My thoughts exactly....... with all this focus on the case I do like the fact that it went ok today but.... it does not mean much until we get down to the nitty gritty. I just wish we could get a update. Being a success with our case while we try to release the funds is a good thing but it also tells us that there must really be a hold on this money big time and they don't care. Bottom Line is Al needs to let us know if we will be hear into the new year. I just don't want everyone thinking today was some kind of major success and we are good for now. Don't get me wrong I have no choice or money into the matter so I will take what I can get but Al said what he said. If this is going to take some time then it would be nice to know. It started with 3 months and now we are on Month 8 Well, sorry for the good luck and lets hope Al can inform us or bring us up to speed on where were at with the possibility of ER

I will do as I said I would do; i.e. you will receive an update from me at such time as we have a receipt for Economic Release or I have reached the conclusion that it is not forthcoming in the very near future. In the meanwhile, please try to understand how very difficult and uncertain this particular time is. I and my associates are working very hard to accomplish what some have asked us to do on behalf of all CMKX shareholders.
What part of this do you people not understand? There are two conditions on which Al has said he will update us. 1. We have ER. 2. Negotiations have broken down and we are going to court. WTF? And just to be very clear for those who STILL don't get it. Not getting an update means that the battle still rages in the background and negotiations are continually ongoing... HOW THE faulk hard is that to understand?

HOW THE faulk hard is that to understand? Great post and I agree but it would be nice to know if there is some kind of timeline on when it would seem that Negotiations are going downhill. Didnt Al also mention he would let us know if "he could not get this done in a reasonable amount of time"? along with ..... the negotiations going downhill? What I would like to know is... Whats a reasonable amount of time? He thought he could get it done in 3 months originally and now we are on month 8. Don't get me wrong I am really not complaining but if ER can come at anytime then great but at this point in time as you know its getting so old being in the dark. If you think about it these statements by Al could keep everything open ended for him, for a long time. We could be into January 2011 and it still has the same meaning. Ya know what I mean? anyway good luck to all, I hope we are not to much further away from getting some good news makers ps With all this said I do understand that if we are moving in a positive direction facing the SEC it may bring us closer to getting ER but who knows

Imminent. Won't go the whole 45 days... Of course Manny was impressed. He's not a trial lawyer and probably hasn't spent a lot of time observing trials. Did anyone else go that has a detailed accounting of the event that they can articulate? While I appreciate Portrush, this indirect communication has been determined to be pretty much invalide over the years. Remember, Pongo told us he heard Al was giddy and that he had great respect for Portrush and Gusjarvis. Well, I do too, but I've never talked to them directly. Manny, please give some facts like you said. Otherwise, this was anothing worse than Acca episode. Mike Mike Mike and others, now the MP3 is out, listen for yourselfs

Allan Treffry 8-2-10 « Thread Started Today at 8:32pm »
-------------------------------------------------------------------------------- (10:07 PM) very_tired15: Nope.. originally, I was told by Al that coming to th=e hearing would be unnecessary because the court would decide the case on the documents
(10:07 PM) very_tired15: that it MAY be unnecessary
(10:07 PM) ground_fog: very tired can you verify what tom miller said, tht you told himsec payment was due last friday?
(10:07 PM) very_tired15: but it was not in our favor, so Al went to srgue it
(10:07 PM) caseco_1_1: allan...the sec guy asked for 30, then the judge turned to al and he said 45 is ok..then it seemed the judge ruled to the court 30 days. can you revisit that with us please? thanks
(10:08 PM) very_tired15: AH indicated that he believes that we will be paid before 45 days... I believe he did not believe the filing of the amended complaint would be necessary
(10:09 PM) very_tired15: The judge originally offered AH the standard 30 days leave of court to amend and AH asked for 45...
(10:09 PM) very_tired15: and the SEC has 30 days to respond
(10:09 PM) CMKX-baby: alan that would indicate Al is in negotiations behind the scenes, even whilst suing the vary people he's negotiating with?
(10:09 PM) very_tired15: I believe that AH is confident that we are soon to be paid
(10:10 PM) Lynn64: then why ask for 45 days alan?
(10:11 PM) rfexciter: Allen were there any media present outside of the courthouse
(10:11 PM) very_tired15: NO media
(10:11 PM) rfexciter: ty Allen
(10:12 PM) redbull_25_1: why 45 days.....its clear to me. Al didnt put all of his evidence in the filing. he is not that stupid. If the bad guys get wind of who the witnesses are and where the evidence is coming from they could and would try to twart it somehow. Hodges is only giving out what he has to when he has to. nothing more nothing less.
(10:12 PM) CMKX-baby: alan is Al negotiating with the government behind the scenes?
(10:11 PM) MichaelWC: very_tired I am wondering why Al did provide more infromation prior to Aug 2nd then we would have to worry about a 30/45 day extension
(10:12 PM) very_tired15: Michael, an attorney pleads what he believes are sufficientfactsto carry the complaint to the next phase. It is common for the other side to pick out vague areas and ask for more facts.
(10:12 PM) tukcid: al would probably ask for longer than is needed finishing it sooner to keep pestering sharholders at bay
(10:12 PM) Gman_G: Allan do u beleive that we will see the sec payment before the 9th?
(10:13 PM) very_tired15: I pray so Gman.. I just don';t know for certain
(10:12 PM) redbull_25_1: he will need 45 days to put the evidence he left out on purpose...but i doubt it will get that far.
(10:13 PM) very_tired15: redbull, this was not an evidentiarty hearing
(10:12 PM) redbull_25_1: he will need 45 days to put the evidence he left out on purpose...but i doubt it will get that far.
(10:14 PM) very_tired15: I was not told either way... I am here because RT asked me to come in
(10:14 PM) readmylips_2: (10:07 PM) ground_fog: very tired can you verify what tom miller said, tht you told himsec payment was due last friday?
(10:15 PM) MichaelWC: very_tired what about a second interpleader do you think that was signed off by another judge and that free us up to be paid
(10:15 PM) very_tired15: I spoketo TomMiller.. and I told him what Mona said, but not that it was due as far as Hodges was saying. I do not have personal knowledge as to when anything is to arrive. I bnelieve the conglomorate was to be announced, or so I heard all over the place.
(10:15 PM) MichaelWC: very_tired what about a second interpleader do you think that was signed off by another judge and that free us up to be paid
(10:16 PM) very_tired15: Probably so Michael
(10:16 PM) Trillionaire1: alan, do we have a paper trial to back up all Al said today?
(10:16 PM) ocean04: Allen, Someone said that you told Koolmoney to stand down and that you also told Kool to tell Tom to stand down. It was also said that you told KoolMoney that we were going to get $1 last friday and $6 this tuesday. Are these things true?
(10:16 PM) very_tired15: The attorney for thye defendants was completely clueless as to the facts of the case and even as to the law.. he was asked some key legal questions by the judge and his response was, "I don't know."
(10:17 PM) very_tired15: I told Kool and Tom to wait until Monday before making any big moves... I never told him $1 and $6.
(10:17 PM) CMKX-baby: Alan why didn't the judge just deny it then alan since the Defendants were so ill prepared? why did Hodge ask for more time? why would Hodges need more time alan?
(10:17 PM) SiriusNews: Allen Tref. what was with all that KoolTalk tonight
(10:18 PM) very_tired15: The SEC is a potential defendant in this case. They did not want to send their own attorney to represent their own. The federal attorney was clueless because the SEC never informed him of the facts. They just sent him to the court to appear.
(10:18 PM) CMKX-baby: so Alan wouldn't u think the judge would have denied just based on their incopetance to not even know what soverign immunity was?
(10:19 PM) very_tired15: KM has asked me 100 times how much we are getting and everytime I tell him the exact same answer - I don't know
(10:19 PM) very_tired15: This attorney was just the attorney who appeared today. I do not knwo if he will be the main guy or not. ]
(10:20 PM) pebbles08: Allan what was the name of the SEC attorney there today?
(10:20 PM) very_tired15: The writtendocuments of the defendants was substantiually better than the performing attorney
(10:20 PM) very_tired15: I do not remember his name. One canb call the Court, get the name of the Court Reporter and ask for a transcriupt
(10:20 PM) ChuckWheat: what would be your one sentence summary of today's events VT?
(10:21 PM) rfexciter: Allen, do you feel that this will need to be done by August 9th ?? (World Settlement..)
(10:21 PM) very_tired15: Chuck.. if I had to give it one word, I would say ,"assuring"
(10:21 PM) MichaelWC: very_tired for the life of me I can't figure out what the trigger is to get us paid, do you have any theories you would like to share with us on what it will take to get us paid.
(10:22 PM) very_tired15: AH said today that if the global settlements are not out by the 9th, then the BIS stops accepoting federal reserve notes. That is a scary proposition.
(10:22 PM) ocean04: Why did Al offer 45 days when the judge said 30. Then didn't Al turn around and say he wished the judge hadn't offered them a delay?
(10:23 PM) very_tired15: Michael, allof the various trustees are under contract and direct orders not to distribute UNTIL the SEC first releases the money
(10:23 PM) INES1OO: did we find out what we read last week was written by judge or somebody else?
(10:23 PM) MichaelWC: so back to the SEC, but Obama controld the SEC, so we are still waiting on Obama
(10:24 PM) very_tired15: the judge believed that the pleadings had the possibility of being corrected
(10:24 PM) rcar202: Allen do you think what occurred today was a "script" if not what was with the DISMISSAL? Do you still think that was a script?
(10:24 PM) very_tired15: brb

more to come...

Now that the MP3 is out of the hearing, hear for your self. So I am not a trial lawyer and never observed many trials; well let me tell you my friend, I was a Police Officer for almost 30 years and have been to so many trials and brought in as a witness, I couldn't count them all!!!!! So don't ever tell me that I don't get my facts straight and furthermore, don't ever put me on the same level as acca!!!!!!!!!!!!!
