In short.... The government filed a motion to dismiss Hodges’ appeal. Contained within the motion is a stay to discontinue Hodges’ brief until the ruling on the motion to dismiss Hodges’ appeal.
If the motion is granted, Hodges loses and the appeal is dismissed. If the motion is denied, Hodges files his brief.
IMO -- I expect the court to rule on this motion quickly.

This screams "it wasn't me" before Al even said what they may have done, if them at all. This reaction , before there was even any action, tells any judge that there is something to this after all. The SEC filing this simply says they didn't take a cookie before Al even said there was a cookie missing. The SEC knows if this were to be brought before a jury what exactly would happen. This is now a judges decision as to whether the SEC is the Security Exchange Commission or the Secret Equity Cheater club. A judge can see through that.

This is all some deep stuff. Either this is a crazy, elaborate plan to keep AH from filing, or we really have nothing and AH couldn't prove anything. Either way, this is way above my pay grade. I'm gonna sit back twiddle my thumbs now.

absolutely amazing on the part of the SEC...............they file a motion to dismiss AH appeal even before AH has had a chance to make his appeal.................a very strange move in the legal system
I doubt the SEC will be successful because this goes against the very heart of the US justice system.....the right of appeal...

It seems this is all over and Al did not succeed. I hope he will give an email explaining what happened and their will no longer be any further litigation. It seems the chapter should close now, right?

Hodges had his chance to present his case. He knew exactly what he was doing. Why all the misinformation between now and then, I have no clue. Hodges did know that not presenting certain information from the start would certainly yield a dismissal.
And so it did. After multiple extensions and delays. Same goes for the appeal.
Now if he had no intention of presenting this information that he should have known was required to continue this process, what was he doing?

The SEC has filed a motion, that's all .. The court has not yet ruled on that motion. Please hold your emotions in check people. Al has a couple of days to file his. Why the SEC jumped the gun, I don't know...

This is crazy, the sec has beaten AH to the punch. They most likely knew AH would wait to the very last minute to file as he has in the past and pulled a pre-emptive strike. By the looks of things, AHs choice to not provide defining evidence has now come back to haunt him/us. I am beginning to believe that AH doesn't have any real evidence. My reasoning being, he had to know what he was up against and the uphill battle he was going to face so why did he bring a fly swatter to a gun fight? He should have laid out solid evidence from the very beginning, plain and simple and not play this cutesy game of hide and seek. To all those that buy that this is all part of the "plan" I just shake my head. If the plan was to have the case end and we would be paid the dismissal would have taken care of that. Looking back on Bobs thank you, did he know about this and was giving AH a final thanks for the effort kind of thing? I know I usually thank a hired person after they have completed their work, not in the middle of it.

The way I read it, they are saying, "We don't want Hodges to have the opportunity to file his brief. We want him silenced immediately and completely".
Either the underlying fascism that exists within EVERY government(and their "ruling" agencies) is being displayed for all to see, or this is just a public dismissal so that we move ahead behind the scenes, imo.
...and I sure hope I'm right about this.

A win in the regular court is just as good as a win in the supreme court. What makes you think that if this is rigged to not be heard or get out to the public that the supreme court will have any different outcome?
