As background, I note the following. In March 2005, the SEC issued an Order Instituting Proceedings against CMKM Diamonds seeking to revoke the issuer’s registration with the SEC. In July, 2005, the administrative law judge issued an Initial Decision that ordered the revocation of the registration of the securities of the company pursuant to Section 12(j) of the Securities Exchange Act of 1934. CMKM Diamonds filed a Petition for Review of the Initial Decision which it later withdrew. The Commission dismissed the review proceedings and entered its decision revoking the registration of CMKM Diamonds on October 28, 2005. In April 2008, the SEC filed a civil injunctive action against CMKM Diamonds, Urban Casavant and others.
