tramp Administrator ***** Re: good poof « Reply #10 on Today at 4:12pm » its dec 4th, i read buisness days and i first thought i read calender days, so its not next year and since we have our certs, this has nothing to do with us and we could get paid now. now when the sec and dtcc pays us, we can be next week, or we can be last. the .008 payment can be given now, thats different from the sec, dtcc, and the fed, because the dtcc is a subsiderary of the fed. and also if any buyouts, that payment is different from the sec and the dtcc. but one thing some that do have good contacts, we must be paid by the end of the year, 07 this all has to be done and taken care of.. even wodan heard that on the europe side, so that info is the same. now, are we last to be paid? only god knows.. i don't think even the sec has a date for us, they are holding the strings right now. In the interests of accuracy, let me point out that the dtcc is NOT a subsidiary of "the fed" or any other organization. It is a private corp.

. The WSJ article said: "If the stock in a given transaction isn't delivered in the three-day period, the buyer, who paid his money, is routinely given electronic credit for the stock. While the SEC calls for delivery in three days, the agency has no mechanism to enforce that guideline." This completely misrepresents how failed trades are handled in DTCC's clearance and settlement systems. In fact, the broker for the buyer does not pay the contractual value for the trade to the clearing system until the stock is delivered, although the broker's customer may be given a security entitlement on the broker's records immediately. That security entitlement is what makes it possible for the markets and investors to buy and sell securities freely throughout the day or over several days. If an investor had to wait until stock was delivered and paid for, they'd have to wait several days to trade that stock again. Imagine an investor buying a stock in the morning, then finding market information being announced mid-day that might adversely impact that stock and then being told you can't sell out your position to minimize the potential loss. Freedom to trade is a cornerstone of our equity markets and a fundamental principle in the regulatory schemes that govern the markets. The SEC has flatly rejected the argument that there are such things as phantom shares or credits being created in the market. A seller's obligation to deliver securities does not go away. And the broker/dealer who acts as a buyer of securities has a regulatory entitlement and the power -- and, in many cases, an affirmative obligation after a period of time -- to execute a buy-in on a failed delivery to force the seller to fulfill its obligations. In a buy-in, the broker/dealer failing to receive the securities essentially purchases the undelivered stock from some other broker, with the selling broker/dealer who failed to deliver having to absorb any difference in price or other costs incurred on the buy-in. And the SEC or applicable market regulator also has the power, under existing appropriate regulations, to force a fail to be closed. (We note that DTCC, in contrast, does not have any such authority.) So the WSJ is wrong in suggesting that there aren't market and regulatory mechanisms available to enforce delivery obligations. Lastly, to include this assertion without talking about the SEC's elimination of the grandfather clause under Reg SHO is to ignore further steps by our regulators to address concerns about closing long-standing failed trades. www.dtcc.com/news/press/releases/2007/wsj_response.php...Flying Moose(cmkxunofficial)

Jump to msg. # chicpick very very very easily my friend you just make them pay whatever you ask them to pay for the certs and it is covered, couldn't be any easier and is exactly what was done. And if they didn't cost anything why did it take some people over six months to get their certs, if they were free they would have got them in a month. I have talked to someone in the business who says cmkx was covered and so where all the other naked shorted stocks or most of them in 2006. It is absolutely a joke to think you first of all would have done a cert pull without seeing absolute evidence of what happened to the share raises, what happened to je's shares and why he had so many, and clear cut documented evidence of what the real o/s was and how it was locked up. You would also have investigated the claims, they did, and made sure all was fine, and it is. You would have heard like all of us did that emerson holds the claims and already have researched that and been fine with it before the boxes arrived and before you did the interplead and before you did the cert pull. When you said we had oil concessions you like me and anyone would have checked so thoroughly before saying that that it would be impossible to be wrong.
But first and foremost like you would have done, like I would have done, and like anyone reading this would have done, we would have done our dd on the surrendered shares list and why je had so many shares and got the evidence of that and evidence of the real o/s and where it was locked up. All of this would have been done before you ever did a cert pull.

Thanks to mgl................... By: bhollenegg 01 Nov 2007, 06:52 AM EDT Msg. 619532 of 619533 Jump to msg. # Urban’s Checks…This is concerning the cancelled checks, which Urban cashed that Chrisl reported seeing during his Tyler Texas meeting with Attorney Bill Frizzell. The following information explains why Urban received and cashed the checks. There are many sides to most of the areas of concerns, but the facts that matters are the accurate ones. Chrisl, “payments made to Urban from Diamond Quality, CMKM and John Edwards totaled out to be $2,030,000.00 based on just a portion of information I viewed from 2002 thru 2003.” The following information provides the link to the SEC filing that states the company agreed to pay Casavant $2,000,000.00 for the Casavant claims in 2002. The payment was financed during this time. Urban was put in-charge as a result of this agreement. This leaves $30,000.00 for 2002 thru 2003. This payment could be part of the interest for the balance owed, CEO salary, and expenses, plus deposits in the 2002 UAJC Irrevocable Trust Fund…a number of legit reasons. The crucial bit of information is what is on the back of the checks, which may indicate what account(s) the funds were deposited. Urban has a 2002 UAJC Irrevocable Trust Account and a 2005 UAJC Irrevocable Trust Account, both with enough funds to loan out over 3 Million Dollars to other companies (see reference below). The reason we know about these two trust accounts is from the SEC Filings submitted by the recipients. How many trust accounts are there that we do not know about since there were no reportable activities like the 2002 and 2005 UAJC Irrevocable Trust Accounts? There could be a 2003 and 2004 Irrevocable Trust Accounts. The checks from John Edwards to Urban totaling approximately $ 1,200,000.00 could be the payments for the claims the Casavants sold to CMKI (see reference below). If Urban was intending to keep the funds for himself, he would have funded all of the accounts in offshore institutions away from the jurisdiction of all The United States and Canadian Authorities.
