Ah Yes Janice..BUT the SEC KNEW it was a scam long before they stopped it...and they Knew about all the fails..and it was out of control and they didn't know how to stop the runaway train..so they revoked it hoping we would just go quietly into the NITE..
Little did they know what kind of stubborn rednecks they were dealing with..
Well i am betting Frizzy and Faulky have the goods on the evil borkers..Lock urban and his crew up and put it to the crooked borkers at the same time...life is good.

Filing Timeliness vs Filing Accuracy?
Do Naked Short Shares Affect a Company's Ability to Correctly File Financial Reports?
How much was this the crux of the filing issue?
Quote from...
RESPONSE OF CMKM DIAMONDS, INC. TO MOTION IN LIMINE REGARDING NAKED SHORT SELLING
MAY 3, 2005
From Para. 3...
"CMKM is very concerned with the SEC's simplistic treatment of "naking short selling" evidence. A cursory examination of the Form 10KSB obtained from the SEC website requests a clear statement of the number of outstanding shares of the issuer. One common definition of Outstanding Shares is as follows: Shares of a corporation that have been issued and are held by public shareholders. The MBA Glossary defines outstanding shares as the number of shares that are currently owned by all investors. It also includes shares (shares owned by officers and insiders of the company) as well as shares held by the public. In light of the auditing requirements of Sarbanes Oxley and the burdens on management to properly verify all required reports, having a complete knowledge of the company's outstanding shares is of paramount importance and not irrelevant. CMKM understands that evidence of naked shorting does not excuse extended filing deficiencies but will prove that such outstanding share numbers are very material to having correctly filed financial reports."
From Para. 5...
"The ultimate proof of "naked short selling" and the extent to which a stock has been "shorted" and not "covered" for any particular issue is transmitted to the SEC on a daily basis from the DTCC pursuant to Regulation SHO. The SEC is resisting all efforts by CMKM to obtain records contained in its own file which might render this issue moot. In the spirit of fairness and transparency, such records should be tendered to CMKM."
In the judgment of the SEC did filing timeliness unjusticely trump filing accuracy?

Aladin, if you go back over the 12/31/2004 shareholder list, sorted by SHAREHOLDER ACCOUNTS, you will find interesting coincidences between Casavant family surrendered shares against the shares retired back to the treasury.

jlecks,
shane, star, united, shore and entourage all have to be in on this. too many friendly and inexplicable claim swaps. just look at the latest map which you can see if you go to shane, star or united's web sites. forest gate appears to be the only "outsider" although it was that company's CEO that talked about the grand consolidation of the FALC in a video back in 2004.

Aladin I think over 622 billion was used in NSS. Of course you should also add in Eton's over 30 billion to that total. I would say it is more like several trillions of shares created by nss. The true bona fide count cannot be fully confirmed. How even since we have cert holders and unshareholders, the bona fide number could be between 7.778 billion to maybe a max of 19 billion.

By: jfarn 02 Nov 2008, 05:02 PM EST Msg. 776336 of 776339 Jump to msg. # Glenn told me last week that a grand jury was convened in Vegas in 05. He said..."it's three years later and nothing has come of it." Ham sandwich protocol not in effect with CMKM.? In practice,a grand jury rarely acts in a manner contrary to the wishes of the prosecutor. Judge Sol Wachtler, the former Chief Judge of New York State, was quoted as saying that a prosecutor could persuade a grand jury to "indict a ham sandwich."[8] On the other side, many prosecutors argue that the screening function of the grand jury operates with greater effect on a prosecutor's decision to bring a case in the first place; though records are understandably difficult to come by, many prosecutors say they simply do not bring cases to the grand jury that they believe the grand jury will not indict. In this way, grand juries may exert more of a check on prosecutors than the "ham sandwich" remark suggests~ In addition to the grand jury information. When I was reviewing with him Operation Dividend and ratios he did not remember the CIM dividend. . Go figure.
