The cert pull was an attempt to document and prove an NSS situation but it failed to prove an enormous NSS, despite some shareholders claims of trillion share or more NSS.
The NSS is NOT being ignored. As has been stated numerous times, pursuing the NSS issue will require significant funding that the company does not currently have. In order to pursue it, the company will need to recover what they can of the stolen assets and money.
At this point in time, there is NO ROI. How could anyone possibly tell you what the ROI is or would be when they do not even know how much they are going to be able to recover?
It amazes me that despite the fact that Tyler has addressed these questions on numerous occasions, there are those who have their fingers in their ears and refuse to hear what they have been told.
Tyler is doing the best they can given the extremely convoluted and difficult situation and with limited funds. If people think someone else can do better, then band together and hire your own lawyer to pursue the case, if you can find someone willing to take it on that is.
In a conversation I had with Frizzell the other day, he stated that it has been difficult to get other lawyers involved in the case, once they understand the situation. Nobody wants to touch CMKX.

Congress the hold up? Where's the money for the shareholders been? Collected? Just not released ( for some time). Well the bill finally passed on two legs.
Republicans have been safe guarding our cash?
Bipartisan support (or the lack of by sheer numbers) going into possibly the largest cover, relief ///release of funds that would dwarf any "ECONOMIC STIMULUS PACKAGE" has been the hold up, and always was the hold up. If it were not we would have been paid already. Numbers don't lie. Who wants to bet that many (capable of casting a vote) knew the plan ?
The task at hand was in getting the Stimulus Package moving. What is in front of it is a long line of trains with relief for various programs that will as I said months ago give this economy the BOTTOM UP FEED/APPROACH to putting the cash into the hands of those that will truly stimulate this ECONOMY- as nothing else could, nor would have. OBAMA knows this. Bush knew this just couldn't get the job done. Being kind again here.
It looks like OBAMA is far ahead of the curve on this, and has done his best to prepare for what will truly be a Transfer of Wealth.

Jump to msg. # Tyler screwed up. The way I view this is that when Kevin was offered the job as interim CEO I can guarantee you that he spoke with Bill Frizzell first. They had a plan and they knew what they were about to do 6 months after the appointment of Kevin. How do I know this cause they were going to file a derivative lawsuit.
When Kevin became CEO the derivative lawsuit went out the window this was the first mistake of Bill Frizzell that will lead to many.
They decided to file lawsuits in the beginning another mistake. A good attorney ways the facts and risks to rewards. Bill Frizzell had no clue what he was doing. If Bill Frizzell would followed the history he would of known that the share corruption in CMKM should of been the first thing attended too. Lets not forget Bill Frizzell believed in a substantial NSS in CMKM and yet did nothing when he became corporate counsel. Bill Frizzell should of halted the T/A the day Kevin took over from transferring certs. Another mistake.
Instead they moved into lawsuit mode thinking they would scare/threaten a few of the plaintiffs into settling. Another mistake. Any good lawyer knows that crooks like John Edwards will not settle anything. Another blundering mistake. As you can see the mistakes are piling up.
They put the share corruption on the backburner cause who was really running this company? Thats right Bill Frizzell was running this company. Bill Frizzell had the money to run this company. Remember something whoever has the money is in control. Mistake by Kevin but who could he turn too at this point?
Now all of a sudden the company is addressing these issues. And a blind man can see what is happening. Bill Frizzell f**ked this up. Bill Frizzell had no clue what he was getting involved in. Mistake again. Most attorneys way their options. Bill Frizzell never consider anything other than throwing #### at the wall to see if it would stick. Another mistake.
This list can go on and on but in reality of it all the mistakes that Bill Frizzell has made allowed whoever the true culprits are to sweep whatever they want under the rug.
But then again this is just my opinion on a chatboard. Thank goodness golf season is getting closer.

(a Nevada-based corporation traded on the OTC market as CMKX) exposed to us on 18th January 2009 the involvement of a Mr William A Frazell, of Attorneys Frazell & Mosley PLL (Austin, TX), Mr Kevin West (the Chief Executive Officer of CMKX) and Mr Urban Casavant, of Casavant Mining Kimberlite International, in connection with the receipt of over $12 billion being the proceeds of a settlement with CMKM/CMKX, known to the Securities and Exchange Commission following a lawsuit concerning ‘naked short-selling activities’.
The California-based shareholder, who is an Attorney, advised us that CMKM/CMKX was very recently ‘converted out’ from Nevada and moved to Tyler, Texas – a corporate move of which the outstanding registered shareholders, who own more than 800 billion shares, were never legally informed. As noted, the source is a holder of outstanding shares in the Nevada-based corporation.
Our sources confirm that Attorney Frazell, acting for and on behalf of CMKM/CMKX, paid a certain shareholder a sum of money equivalent to $0.02 (two cents in the dollar) per share and that the shareholder was made to sign a non-disclosure document demanded by Attorney Frazell, which allegedly denies any information to the remaining outstanding shareholders.
Non-disclosure documents are essentially illegal and are of no effect, rendering the transaction itself null and void (which is the case anyway, as the payout is fraudulent).
Consequent upon this operation, we were advised that $12.8 billion of Settlement funds are or were initially missing and unaccounted for, while the Attorney, W. A. Frazell, was not cooperating with the other shareholders in any attempt to identify the location of these missing funds. On 20th January 2009, it was confirmed that 639 billion shares were paid out at a price of $0.02 per share, equating to a total payout of $12,780,000,000.
The significance of this detail is that, in an earlier conversation with the authorities, the city of Tyler, Texas had only recently been mentioned in the context of the release of ‘settlement funds’, and in the context of known activities of Bush Sr. associates in Dallas, Austin, and Crawford County, Texas and the relevant background involving Delmarva Timber Trust et al.
The 639 billion shares that were sold short were sold WITH the knowledge of the Securities and Exchange Commission. Under the relevant lawsuit concluded in late 2007, settlement funds were to be paid out to all holders of outstanding CMKM/CMKX shares.

They continually fuel the fire that comes to them by way of excuses, lies, propaganda, with their fear of what they know to be the truth somehow being stolen away from them by the words of others. You cannot circumvent the law or ignore the penalty that it imposes. The burden of proof with CMKX , its massive shareholder force has been proven in the tens of thousands of times, X trillions of unit counts (ultimately) in documented NS shares, and is now precedent by laws. Public companies are leveraging their burden of proof in the open forum/legal system as a guarantor of payment for the entire market, while the private negotiations have well under went the massive task of their virtual negotiations for huge damages and the "structured settlements" by virtue of the Maheu maneuver certificate pull. -But lets make one thing very clear; There is a fine balance going on here. If the measure tilts too far one way or the other (without a final conclusion to compensate those harmed) the collapse of a financial system will occur. It will occur if corruption does not become accountable on all levels, and we cannot live in a lawless society of massive counterfeiting, corruption, whether it be in the public management of securities, public trade of securities i.e., Wall Street, or the revocation of companies like CMKM DIAMONDS with an existing massive naked short associated to an absolutely huge valuation on Canadian soil. (No compromise for restitution.) No way out for the Economy.
It will unhinge the default of so many other massive lawsuits (that will occur) upon the failure of imposing damages to suit the crimes commensurate to such massive failures and disruption. It is the reason for such disharmony, lies, commotion, misinformation, and mostly WHY what is being dealt to the shareholders changes daily. IT CHANGES DAILY by design. If it does not make sense then it probably isn't true, i.e. TYLER TEXAS... Also,,,, Which means when many of you saw those pictures of Urban up on a web site advertising those tee-shirts with him behind bars, and as a convict on the same page as "Bank in the Box" years ahead of his negative media you would have to say that the man knew something well in advance and was sending a well intended message. Both a message with a beginning, middle, and an extraordinary ending! That was the hint for all shareholders of record. So let me tell all that believe that the message never changed. We will not know anything (really) until the day that we do know something. If that makes any real sense to you.

We had a regular routine of nothing coming out of Texas until Bob and Al teamed up together.
In the battle to win the shareholder's hearts, minds, and trust, Tyler is so far behind on that score that they'll probably never come close to catching up.
It's amazing what a little openess, straight communication, and a bit of hard work can accomplish.

And I think you've got that right. I guess I really didn't see it quite that way before reading your post, but when you speak I listen and you've got my mind changed a bit on that.
I give Tyler credit for evidence gathering and initiating some measure of action on our behalf. However much they conceal and however inept they can be, the body of their work is quite substantial. Even with regard to the DTCC's Mr. Richard, it's evident that the Tyler Boys got to him before Al Hodges did; but, even if they did, they did so only after other shareholders got there before them. And they do seem to lag behind other recent shareholder efforts (the Charyn Aldred thing to name the one with which I'm most familiar).
The Tyler Boys do seem like they're trying to make a grab for the front page after having been buried in the back pages for want of a good, positive story.
