Clearly the position of the SEC is clear. The Division of Enforcement will not investigate investor complaints on naked short selling because they do not believe the investor complaints are of value. Instead the SEC passes responsibility on to others as they have done so many times before. I ask, who generates the empirical data the SEC wishes to see? Who other than the SEC has access to the micro trade data necessary to formulate such a study? By public disclosure the OEA has failed at taking such a look at the information instead rationalizing teh issue away the way the SEC's New York Bureau rationalized away Bernie Madoff. A closer look at the SEC response exposes the reality of how out of touch the SEC really is. The Division of enforcement does not come to work looking for the big fish, they go to work with preconceptions that allow fraud to take place right under their noses. They appear lazy and irresponsible. Please accept my sincere thanks to all of you that have responded to our request for information on certain companies and individuals. We received quite a bit of information that was not known to this office before your help. This will be helpful as we continue our investigation. We will be looking for information on other people and companies in the next few days.
John has told me of many rumors circulating around the message boards regarding things I have said or not said. I have not been answering many emails due to other matters that are taking up my time. It is safe to say that I am trying to provide any significant information to all of the members at the same time through these updates. If it is not being provided to you from these updates, one should have some serious questions about the validity of the information.
We have contacted the FOIA specialist at the SEC and we have made financial arrangements to pay for our requested materials. We have made arrangements for two people to assist the specialist in obtaining our documents. These people have agreed to go in person to the SEC offices to retrieve our information once it is released. The specialist has been very pleasant and it appears we will have the material in relatively short order. We have asked if it is possible to obtain the documents within the next two weeks. We do not feel like there will be a problem obtaining our mat! erial in this time frame. I will update you with a more specific time table once I have confirmed specific dates on when we will be allowed to have access to the documents.
I should have an inquiry letter out to TD Waterhouse Canada tomorrow. The letter will be self explanatory. This will be sent to you via another update. Mr. Stoecklein is back in the country. We spoke at length today. I have explained the concerns over the drilling report submitted with the 8K. Mr. Stoecklein has assured us that his office filed with Edgar the entire report he was given. The mystery of the missing Table 1 still looms. He knows our concerns and plans to visi! t with the individual that sent the drilling report to his law firm. New Investigations and Possible Litigations
I recently contacted Chris Bebel (www.chrisbebel.com) We discussed several areas in which I believe he would be of some great assistance. We are discussing a consulting agreement at this point. Chris has written several published articles in relevant areas. He is a former Assistant U.S. Attorney (DOJ) and a former SEC enforcement attorney. He is a highly sought out expert in several areas of securities law. Chris’ work and contacts in the NASD may be very helpful to us.
The information that many of you have provided as well as the documentation we have received from the SEC and the company has given this office a number of areas for further investigation. We have certain key individuals inside this company, that I believe illegally sold mountains of this stock in 2003 and 2004. I would love to contine my efforts with the SEC, the DTCC, and the NASD to determine full disclosure of these trades. I cannot go into further detail in this forum because I know these updates go directly to the bad guys. I plan on a new FOIA request asking for the SEC to reveal the specifics of the NASD investigations that have occurred in the past in CMKX.
We are knowledgeable of many bulk (billions) trades that occurred through certain companies that are clearly not retail customers. I would like to continue to investigate these trades and the companies involved in these trades. We have many bad guys that made fortunes on this stock during the last two years. I would love to hand deliver to law enforcement in a neat package the evidence necessary to indict those that are guilty of wrongdoing. Additional work is necessary in this regard.
There are tremendous tax consequences to many of these transactions. I am convinced there are those who want us to fail so they can escape certain tax liabilities. We should continue our work to see that these individuals do not have sufficient input to hamper our filing process.
Asset Evaluation
There are many of you who believe we are on a wild goose chase and that the company’s claims are worthless moose pasture. I do not know the value of the company’s assets. If the company is willing to share some information with me, and pay my way to Ecuador and Canada, I would love to make the trip. I would look forward to reporting my findings to you upon my return.
The ultimate outcome of everyone’s investment hinges not on naked shorting or SEC actions, but on the true evaluation of the company assets. We have some information about these assets, but we need more. The more I find out about the company, the more I become concerned that neither the company nor the SEC wanted you to know about the evaluation of the assets at the Administrative Hearing.

Just heard that the IRS is giving all the Madoff victims there tax money back because they were scammed, something like 10 billion of our money. They have not collected that back from him. Where is my money, I was scammed!!! our government has become a joke and a laughing stock, what do you think the rest of the world thinks of us now? For the first time in my life, I am ashamed of what this country has become!!! And Obama's BS ain't gonna help at all! I'm glad it didn't take him but a few weeks to show he is as full of it as some warned!

That is because Madoff's VICTIMS are mostly other FAT RATS...although there were a few innocents invested as well...but don't you know that if CMKX VICTIMS were HOGS then US HOGS would be getting some SLOP...Madoff's VICTIMS were HOGS and many knew Madoff was using GREEDY TECHNIQUES like NSing to make those INCREDIBLE PROFITS IMO...Flying Moose(cmkxunofficial)
