how is it that given the might and experience of the entire US justice system and securities and exchange commission is incapable of bringing this SLUG to JUSTICE?
the fact that they can't says to me the guy is innocent and his defamation of character suit against the evil forces of the SEC deserves to move forward.
if the US GOVERNMENT can't win a case against this ignorant SLUG after this many YEARS then the poor slob deserves to be compensated for defamation of character.

I wouldn't be overly concerned with what Leslie Hakala has to say, I mean it's not like the SEC is world famous for being straight up with the public anyway, lol
Besides, Leslie probably was being straight up but we need to remember the context in which she was talking. The SEC's primary responsibility is regulating the trading of securities. Yes, they do on occasion facilitate fair funds distributions from fraud and things like that, but they are primarily in the business of regulating the securities trading markets.
So when Leslie said there are no payouts, this can be a very loosely interpreted statement. From the SEC's perspective it may very well be true, but from a DTCC, FINRA or some other agency's perspective it may be a different story all together. The SEC is only one avenue in which we could hope for a payout and/or settlement, there are many others out there.
Even if Leslie was aware of a payout, she would not be at liberty to discuss or admit it over the phone to a shareholder that called her. The dissemination of that type of information would have to go through the appropriate channels, and all agencies that were involved would have to be in agreement that the case has been completed and the information is ready for public distribution.
There are many anomalies with CMKX and the way the overall case has been handled that should cause us to be suspicious no matter what any agency tells us. For instance, it is not unusual but it is somewhat rare for the SEC to file a complaint and sanctions against a company or individuals for fraud, without criminal charges being filed at the same time. Take the IHUB case, and the Madoff case as just a couple of examples, there are many others.
Leslie has also made some recent comments when asked why the SEC was not going to pursue a certain legal action (I don't recall exactly what it was) but her response was, that is for was "strategic reasons" in which she was not at liberty to discuss. Molly White also recently said the SEC was not going to pursue a Default judgment with the judge handling our case, because as a matter of procedure it was not the right time to do it.
I think these two reasons alone should tell us there is something else going on behind the scenes that is causing the SEC to stall for time. It most likely has something to do with other agencies doing whatever it is they are doing. With that said, we may in fact see criminal charges come down in the near future, and this was just one of those cases where the SEC complaint and the criminal charges just didn't happen at the same time. On the other hand, there could be something entirely different going on.
So to recap, just because the SEC says there is no payout, doesn't necessarily mean there is not some other agency working to put one together, and the SEC is simply out of the loop on it.
Just a few things to think about.

as i've said for years now, if they have the key to open the door then it is also clear they don;t have the power to turn the key. they (whoever they are) are weak. they can't call the shots. they can't force anything on shorty, otherwise they would have had this thing resolved YEARS AGO.
so, without the power to get things done then we are left with a group of SEC eunuchs running our show, and i'm increasingly afraid they will be with us for years to come, and will be quite content since it allows them plenty of time to lay on the southern california beaches tanning and drinking their pina coladas.

read that article and you will see that the MADOFF investors are receiving carte blanche treatment,,,, and they are b*tchINGGGG! good god! yes, these people were cheated out of a ton of money,,,, but they have seen JUSTICE done in less than a year AND the government has set up a mechanism whereby most of them will get something back. it is not much, but at least it is something! and still, the MADOFF people are b*tchhhing,,,, versus us.
CMKXers who have had their money systematically taken from them under the eye of the SEC back in 2003, 2004 and 2005 and have nothing to show for it! NOTHING! neither the government nor our good buddies in TEXAS have done a ####### thing for us that amounts to more than a hill of beans.
ohhhh, yes, the TYLER boys have talked big, but when you really analyze what they have produced for us either in the way of getting JUSTICE (whether that justice is seeing someone arrested and going to jail, or seeing some money come back from EDWARDS or whoever else, well, they haven't produced. TYLER has struck out.
and the SEC under HAKAKALALA isn't any better. the SEC if a toothless tiger when it comes to the CMKX case. i thought the SEC and FEDS went around tearing new asssholles in the buts of anyone that didn't play ball or committed a crime, like MADOFF. but when it comes to CMKX they stand around scratching their collective heads and pubic hairs at the same time. talk about looking like brain-dead monkeys!

Since they were making huge amount off their money, they should have known something was up. The SEC sure should have known something was up. One investor invested 1.8 million and cashed in 3 million after four years and lost 4 million at the end. Another couple invested a million and retired and travelled the country for years before they lost it to Madoff. It was blood money from illegal acts.

Current low zinc prices mean that the industry is not investing capital to replace resources, reserves and future production, he told analysts and investors on a conference call. “I think that we have the prospect for a structural change in the zinc market going forward,” Wright said. The price of zinc rose above $2/lb in early 2007, but retreated since then, to fall to around $0,50lb by year end. However, like copper, the metal has regained some ground this year, and was trading at around $0,70/lb on Thursday. Lundin has halted zinc production at its Neves Corvo mine, although it continues to produce copper, and has suspended all significant capital expenditure on a project to expand the zinc processing facilities at the operation. However, the company is ready to turn the ignition on its zinc projects “as soon as we believe it is appropriate”, Wright said. “It would be a grave mistake to think that we have lost interest in these projects. They are vital to the future of this company and we remain very committed to those.” Besides copper output at Neves Corvo, in Portugal, Lundin continues to produce zinc at its Zinkgruvan mine, in Sweden, and owns a 24,75% stake in Freeport-McMoRan Copper & Gold's Tenke Fungurume copper/cobalt project, in the Democratic Republic of Congo, which is now producing copper.
