As I have said before, Al Hodges would not have said in open court that they exist, if they did not. That is the point BH is making above. (in addition to ripping on the lying bastiche he was replying to.) So why didn't Al present the documents to the Judge at the hearing, why the stall? Some will say because this is a timed event and he can't present the evidence to soon. Others will say that AH is being lied to and the evidence doesn't exist. You pick!

Al did not present the documents at the hearing simply because they were discussing the format and structure of the required re-filing.
And yes TallyHo, if and when the time comes for the documents to be submitted, they will become part of public record. However, that timing would be during the actual trial which happens after discovery.
We may yet end up re-filing and we may end up getting to discovery, but I very highly doubt we will go past discovery.

And yes TallyHo, if and when the time comes for the documents to be submitted, they will become part of public record. However, that timing would be during the actual trial which happens after discovery. We may yet end up re-filing and we may end up getting to discovery, but I very highly doubt we will go past discovery. Yes, but Mr. Hodges will have to provide sufficient evidence to substantiate the claims in the amended suit. And, even then the chance of the case being dismissed under rule 12 is relatively high. Looking forward to sept 16.

The Bivens suit itself is one such document. The FACT that such a document exists claiming the existence of a trust fund DOES NOT PROVE there is a trust fund. I think what you're really asking, lovindiamonds, is to see the TRUST FUND DOCUMENT itself. Fat chance on that desire being satisfied. And Robert, you know the difference.
