n-y-p, I'm thinking that it all has to happen at once - the nss paid and RR done, so we aren't left out of engaging in a new entity. If we are paid, our nss goes away and we are left without the RR offer. Acca offered the newest suggestion that we get the damages first, then RR and "divi" next. Just a thought.

newtopennies, i agree with you. why aren't we joining this effort? why isn't frizzell and kevin stepping forward and saying, "we need to join this national effort to go after those who have naked shorted us"?

maybe the reason we're not doing this is because we weren't naked shorted? is that possible? maybe the problem doesn't lie with naked shorting and the ONLY problem resides in the illegalities surrounding edwards?

maybe urban did what ever he did to screw edwards and what he did never involved naked shorting?

who knows?

however, i would think that if you wanted to get the naked shorts you would join forces with a bunch of others and do what you could to cut off the heads of those responsible for naked shorting you to death.

either the sting theory is right or it's something else altogether.

ROSEN...IF WE were not naked shorted, then WHY DID HE SAY IT??? I did hear a rumor years ago that Mr. Casavant was a victim of naked shorting with Petro Plus or another company he owned, and that he vowed it would "never happen again", or some such statement, but it is just a rumor and my opinion. Of course if there were any truth to it, it means that Edwards and his kind were "set up" long ago to take a fall, and CMKX could have been used as a 'sting' vehicle. That still leaves us all with questions about where the money is, if any of it belongs to us, and if all we own are naked short shares, then who's responsibility is it to see that we get paid? Are Naked Short Shares worth ..005 or .54? Were shareholders just "Used" to make a point to the SEC and oversight Federal Agencies about a 'numbers game' with the brokers, and when our usefulness has been completed, will we be left 'high and dry'? Don't know. GLTY. All the above is my speculation only. eom.

Hi Everyone,

My brother called me on Wednesday and filled me in on what is going on. Over the last 3 years he has laughed at me when I told him about CMKX. He called it a scam from day one. I always rebutted his statements and told him it was a sting and he would see very soon. Of course very soon didn't happen and many times I questioned what I had got into.

Well things have changed. I cannot tell you where he works for his own safety, but our most recent conversation was eye opening to say the least. The treasury is posturing before the public at this time just prior to the federal reserve being moved under it's umbrella. Paulson is the presidents key man and is running the show on that end.

The Sec is being disarmed. He also said numerous payments are being released behind the scenes to various companies but you will not hear about them. He is not sure how they are doing it, could be an NDA.

He said that CMKX will be handled very quietly, but the ownership in one company will turn the future into a windfall of unimaginable wealth.

Now you know why I picked this alias

The system changes are real. Unbelievable.

A few thoughts before bed:: Upon reflecting on several of resident basher posts, it finally dawned on me that several of them are quite possibly clueless about many things that have happened and are happening regarding CMKX. There is a myriad of factual information being discussed not only north of the border , but in the Big Apple and the District as well , by people far more important and knowledgeable then any of us here on the boards, and certainly the cowboys down south. The finality of the CMKX saga is merely a spoke in the wheel of what's occurring in broad daylight in the worldwide financial communities. Perseverence, faith , and an enormous amount of dumb luck, has created the "stockplay of a lifetime" senario for a miniscule number of investors in the global financial arena.There is no stopping it, there is no altering it. It will merely happen in it's own time and it's own way. Believers and non believers will be rewarded regardless. The constant rhetoric on the boards meant to discourage and disappoint, is useless and empty. The die was cast several years ago . The implementation has taken far longer then first thought. But then , NOBODY promised us it would be easy and quick. That was merely wishful thinking.
Believers KNOW what awaits us:
Dreamers pray something will happen:
Non believers will soon find out what awaits us"
And the Old Team will soon revel in the vindication and rewards of their monumental victory. Just some thoughts from someone who believes every word of this post is true.

Secondly I have already spoken out against such irresponsible posting on many occasions. In the past 24 hours as a matter of fact. So don't preach to me.

And last but not least, there is more than one way to play with shareholders heads and people on both sides of the fence are doing it weekly.

Your own favorite CEO hasn't exactly treated shareholders with ANY level of respect so if you want to start a crusade then start at the top.

Former UBS President Arnold Proposes Overhaul of Bank (Update4)

April 4 (Bloomberg) -- Former UBS AG President Luqman Arnold called for a breakup of the biggest Swiss bank after about $38 billion of writedowns on debt securities erased more than half its market value in the past year.

Arnold, whose Olivant Advisers Ltd. holds 0.7 percent of Zurich-based UBS, made his proposals in a letter to board member Sergio Marchionne released today, and asked to meet before the annual meeting on April 23. UBS reported a 12 billion-franc ($11.9 billion) first-quarter loss on April 1 and said Chairman Marcel Ospel will leave.

UBS rose as much as 4.6 percent in Swiss trading after Arnold said the bank should consider selling its asset management unit to raise capital because a planned 15 billion-Swiss franc rights offer ``may not be sufficient.'' Wealth management and business banking should be separated from the investment bank, he said. He also urged UBS not to name Peter Kurer, the bank's top lawyer, as chairman, and asked Marchionne to head the board while the company looks for a banking expert to succeed Ospel.

``We believe that a substantial recapture of shareholder value will be achievable,'' Arnold said in the letter. ``There is an urgent requirement for effective and relevant leadership of UBS's supervisory board'' as well as ``a clearer and more focused corporate strategy.''

UBS rose 76 centimes to 33.16 francs by 10:25 a.m. in Zurich, bringing the bank's market value to 68.8 billion francs. UBS is the second-worst performer this year on the 60-member Bloomberg Europe Banks and Financial Services Index.

`Fundamental Overhaul'

``Given his former insider status we believe the letter will have an impact,'' Derek De Vries, an analyst at Merrill Lynch & Co., said in a note today. He rates the bank ``neutral.'' ``We think the breakup value will once again come into focus.''

The bank will review the letter and respond ``in due course and in an appropriate form,'' said Rebeca Garcia, a UBS spokeswoman.

UBS, the world's largest money manager, said on April 1 that it will replenish capital with the rights offer, after already raising 13 billion francs from investors in Singapore and the Middle East. The bank will write down $19 billion on debt securities in the first quarter, bringing the total to almost $38 billion since the third quarter of 2007. The bank has piled up net losses of more than 25 billion francs during the period.

UBS needs ``a fundamental overhaul of risk discipline and more open and transparent communication'' both internally and with the market, Arnold said.

Rising U.S. mortgage defaults have caused about $232 billion in credit losses and writedowns at financial companies worldwide.

Bear Stearns, Lehman

The near collapse of New York-based Bear Stearns Cos., the fifth-largest U.S. securities firm, and its takeover by JPMorgan Chase & Co. heightened concern that some of the largest financial institutions are at risk. Lehman Brothers Holdings Inc., the No. 4 U.S. securities firm, raised $4 billion from a stock sale this week to quell speculation it's short of capital.

UBS's $19 billion writedown in the first quarter compares with shareholders' equity of 42.5 billion francs at the end of 2007. The year-end figure doesn't include the funds raised from Government of Singapore Investment Corp. and an unidentified Middle Eastern investor last month.

Standard & Poor's cut UBS's long-term counterparty credit rating by one level to AA- this week and said it may lower the rating further after ``risk management lapses.''

Most `Valuable' Unit

UBS, with about 2.3 trillion francs in private-banking assets, said clients in Switzerland withdrew funds in the first quarter. The Swiss redemptions were offset elsewhere and net investments were ``slightly positive,'' Chief Executive Officer Marcel Rohner said on a conference call on April 1.

The wealth management unit is ``the most important and valuable,'' Arnold said in his letter. Separating it from the investment bank, which could be put in a U.K. or U.S. holding company, would still allow UBS to generate revenue from cooperation between units. The operations would all still remain, ``at least for the time being, under one roof,'' he said.

``We are not convinced that the `one bank' integrated business model that has served UBS well in the past will survive the damage inflicted by the proprietary trading losses and the writedowns,'' he said in the letter.

Arnold also proposed that UBS should ``seriously evaluate'' a sale of its Pactual Brazilian unit and the Australasian businesses to raise more capital. Some businesses within the investment bank will also command ``an attractive valuation once markets have stabilized,'' he added.

Ospel, Kurer

Losses cost the jobs of former CEO Peter Wuffli, finance chief Clive Standish and investment banking head Huw Jenkins. Ospel was supposed to stand for re-election at the shareholders meeting on April 23 for a shortened, one-year term.

Kurer, 58, who joined UBS in 2001, has been a member of the executive board since 2002. He previously worked at law firms Homburger AG and Baker & McKenzie in Zurich. Ospel told journalists on an April 1 conference call that Kurer was chosen because he ``has a profound knowledge of global financial markets and of course of our bank.''

Kurer headed Homburger's corporate transaction group and worked as counsel on mergers including Ciba-Geigy AG and Sandoz AG and the 1998 sale of British American Tobacco Plc's financial- services unit to Zurich Financial Services.

`Skills' Lacking

Arnold wrote that Kurer ``lacks precisely those skills most relevant'' to the board and called for an ```outstanding Swiss banker with proven strategic, risk management and communications skills be brought in as soon as possible.''

UBS expanded its fixed-income operations at the peak of the U.S. housing market, only to join the list of investors burned by bets on U.S. mortgages in 2007.

UBS was among the first stung by the subprime contagion when its Dillon Read Capital Management LP hedge fund, run by former investment banking chief John Costas, lost 150 million francs in the first quarter of last year. By May, following an internal review of the losses, UBS decided to close Dillon Read.

The company posted a 12.5 billion-franc loss in the fourth quarter, the biggest ever by a bank.

Every pumper on this board was telling people they had to buy in immediately or lose out on the massive return way back in 2004 when this was being hyped. All kinds of crazy valuations and all pumpers claiming the big news and the big return was so close that hesitating even 1 day before buying could eliminate you from the windfall.

Who you trying to kid?

Only after all those fools bought and asked where their money was did the pumpers change their tune and tell them to be patient. But when this was trading like a raped up the concensus among pumpers was buy right this very second or risk being left behind. 2 years later it was revoked and to this day not a single penny has been returned. And not one single pumper stated the return could possibly take 4+ years to take place.

Hi Everyone,

My brother called me on Wednesday and filled me in on what is going on. Over the last 3 years he has laughed at me when I told him about CMKX. He called it a scam from day one. I always rebutted his statements and told him it was a sting and he would see very soon. Of course very soon didn't happen and many times I questioned what I had got into.

Well things have changed. I cannot tell you where he works for his own safety, but our most recent conversation was I opening to say the least. The treasury is posturing before the public at this time just prior to the federal reserve being moved under it's umbrella. Paulson is the presidents key man and is running the show on that end.

The Sec is being disarmed. He also said numerous payments are being released behind the scenes to various companies but you will not hear about them. He is not sure how they are doing it, could be an NDA.

He said that CMKX will be handled very quietly, but the ownership in one company will turn the future into a windfall of unimaginable wealth.

Now you know why I picked this alias

The system changes are real. Unbelievable.
