I really don't see anything good coming out of any of these suits for anyone other than Tyler. If you can show me otherwise I would be happy to listen.
* Contrsuctive Trust & that means there's a legal paper trail 4 all assets recovered.....and save to your computer the Faulk/Kevin interview cause it's them saying they won't stick around after recovering assets.....that means they won't be spending
What I don't think most people realize is three important points.
1. I don't think there is going to be much to recover because I think they will find that most of it was spent or hidden in offshore accounts. It will never be recovered.
* I bet they recover all judgements
2. What IS recovered will have a tremendous amount of expenses and payments taken out of it before anything could be left to the shareholders.
* Faulk said $350-$500K is CMKX's debt so far.....ok,,,I can kinda cheat that answer since the MP3 came out before my reply....although I wouldn' thave been able to answer that nayway other than to say.....KEvin said we were being billed at industry or below,,,,,,Faulks comments seems to have now verified that
3. The cost to distribute what is leftover to 40,000+ shareholders is enormous and could conceivably make it not worth the effort.
* WHo said there'd be a distribution??....i've always said shareholders need to stop acting like their due something and that any distribution at this level wouldn't make any business sense at all.
It's either reduce the crooks and do a goin outta biz one time pay-out or boot tha crooks and use the money to make shares valuable....which is actually what Kevin has said,,,,,,,trading again and said again in that interview.
One last thing, if Tyler AND the SEC both get judgments on the same assets they could be in a position to have to negotiate a split of these funds/assets. This would further dilute any potential return.
* if CMKX can get at least 50-75% of what left....cash wise and back into tha claims,,,,,,i'd consider it a blessing considering just a few yrs ago we were told.....O/S is 703B,,,,,,anyone who says they're mouth didn't hit tha floor is tellin a fib
This is not just MY opinion either.

Hey Mark,
With all due respect to your comment below, this would probably be the best time to pursue the so-called naked short issue that the company attorney stated that we have. Especially if the Bush administration sets up some form of trust or whatever they will call it. Why can't we get first dibbs on that cash if we have a proven short.
It's great to see that you want to set up a chat line for the shareholders but to me it will be nothing more than a canned response as it has been for years.
You say don't listen to the rumors but the company doesn't give anything meaty to absorb and when a person feels down, those rumors sound very plausible. Sorry but that's the way I see it.
Now for the question that never seems to go away. To the best knowledge of CMKM Diamonds, Inc. and anyone employed by the Company, there is no trust fund, money, or settlement in existence anywhere waiting to be distributed to CMKM (CMKX) shareholders. If anyone believes that they have evidence of any outside entity who can confirm otherwise, I believe it their duty as a CMKM shareholder to contact the Company immediately and pass that evidence or information to us so that we can convey it our shareholders. The Company has made this request several times in the past, but to date, has received not one single shred of anything remotely resembling evidence of any kind. Otherwise, any rumors on the boards should be considered to be nothing but baseless rumors or lies. For your own well being, ignore them.

If you call being transparent by telling us what most can get from court filings transparent then I guess you can define it that way. But any corporation that has shareholders have the right to know salaries, financing and who is making the companies choices. But that's what happens when you don't report and the reason Urban was able to get by with what he did. Tell us what you want us to know and hide the rest. BTW, why is there money to fight all these legal battles, but none for a shareholders meeting & vote?
