rosen, my response to your questions are based on my past years of working with Uncle Sam...sometimes in a regulatory manner.
question: what are you thinking about the nss and the possibility of a return to trading?
If I were the Govt and CMKM was naked shorted to the extent that most believe, I would want CMKM to go far, far away...never to be heard of again. I would devise some methodology to settle this quietly, but doing so in a manner that would not disclose or elevate the issue or extent of nss. I believe that nss is rampant...thus disclosing the magnitude of the problem would be very negative to the market and that is far from what the govt wants right now. As such, I would expect CMKM to go away. However, if CMKM does trade again, imo it will not be as a mining company, it won't have the Casavant name, and it will not have the ticker symbols CMKI, CMKM or CMKX. In other words, if it trades again, you won't be able to tie it to the Casavants in any way, shape or form. Too much has been done in the media and through SEC enforcement documents that taints the company and would prevent it from properly trading in its current form, imo. Also, if CMKM was naked shorted to the hilt and all outstanding naked shorts had not been resolved, resumption of trading talk coming from Tyler is the last thing the Govt and brokerages would want to hear...and was probably being used accordingly by Tyler.
question: if we did return, are the policies put in place in the market going to really stop FTDs, or will the brokers still be able to work the system to their advantage?
I think significant changes were made to the regs and finalized on Oct 17, 2008. While the new changes don't cover all the loopholes (see investigatethesec.com), they are a good start, imo. But there are still problems out there. It is my understanding there are other avenues broker/dealers have, such as credit default swaps (legalized gambling) and options trading, that aid and abet their efforts to short a stock and improperly drive the price down at the same time. So as long as we have criminal minds out there, they will continually search for new avenues and methods to accomplish their mission. The key to stopping them has been and will always be adequately staffed independent agencies that aggressively update and enforces the laws and regulations without simultaneously having their staff applying for much higher paying jobs at the companies being examined/reviewed. Right now I think the small companies and the individual investor would have better luck in Vegas. I hope it changes soon.

Hello Goodolboy27, No update yet.
I do not know Deli personally, just what I read on the boards. I do not know the rules on what determines if a person is a broker or a private trader. There seems to be a gray area on this determination. I was under the impression CMKM's company Attorney Frizzell amd CEO West said the shares and transactions from Deli are good.
What post are you referring to?
Thank you, BHollenegg

bhollenegg, Frizzell originally said those shares were good. However, Bill's correspondance with me suggested that the SEC would rule on that issue.

from the Millionaire Board..... RAWPOWER DIAMOND DIGGER Re: SEC « Reply #8 Today at 2:15pm »
As I have said for a long time KW and BF, are doing nothing more than funds recovery and profiting from it. I would assume 20% minimum. That is why they dropped the NSS issue. I also would assume the person responsible for paying their salaries is getting a cut also. The information you put out about the company and what you are doing is totally worthless. If you truly wanted to see a ROI for the shareholders then you would use the power of many voices to shake the walls. Instead you pass out BS thick as can be. If I am wrong prove me wrong! Praise God for men like Bhollenegg, and AClifton Hodges at least they are seeking the truth while you and partners in crime “steal”. Sorry if this sounds blunt, but until I see proof in black and white then nothing will change. For 5 years you have proved no better than the original people that stool from the company. Shame on you guys.

From the Millionaire Board..... Nancyhfrga DIAMOND JEDI Re: SEC « Reply #13 Today at 9:25pm » Though I know nothing about what's true or not, this is what I found on the subject. Anyone can see this and find it for themselves as RUMOR. It was an alleged conversation between Barry S. (Imsoweary) and Frank Love of JMCP. As far as I can guess, this whole thing about Deli is more bouncing ball stuffium to keep shareholders stirred up and occupied. At any rate, you can read this for yourself and many probably have already discussed this from way back when: ragingbull.quote.com/mboard/boards.cgi?board=CLB01328&read=242"Deli doesn't know anything about securities law and as a matter of fact, (Frank Love) helped him file a REGDEX with the SEC so he didn't jam himself up".
Also, "(Frank Love) has been working with Kevin West and Bill Frizzell for the last 2 years or so and provided them with a vehicle to move forward with their shareholders, big money....don't worry". What will be really interesting to see is what comes out with Mr. Hodges. Ultimately, he should have a large number of shareholders to step up with him and move forward, IMO.

And think again if u think tha "TF" or Bill Frizzell will have anything to do with this "Deli" schit. 1. The TF was a volunteer group that gave their opinion 2. The SEC has already cleared Kevin and Bill via that agreement 19. Are the certificates that we received legitimate proof of ownership for CMKM Diamonds Inc.? And does that make us “Bonified” ? A) If you received a certificate from 1st Global Stock Transfer for shares that you bought through your brokerage house, then most likely you are a bona fide shareholder of CMKM stock. IF YOU HAVE PURCHASED STOCK THAT WAS LEGALLY OBTIANED and you paid real consideration for that stock, then you are most likely a bona fide shareholder. And this one..... Q) Marco Glisson a.k.a. Delidog was involved in the selling of CMKM certificates for a long period of time. As far as I know, he is not a broker, and not legally entitled to do so. I was surprised he was not one of persons named in the current SEC indictment. Can you shed any light on this? A) Unfortunately, the company cannot shed any light on your concerns. This is a question that can only be answered by the SEC. The Company has no intimate knowledge of the SEC investigation or to any official questions surrounding the persons that were named (or not named) in the SEC lawsuit. It is our understanding the SEC continues to investigate the present and PAST SELLING of unregistered shares by a number of former shareholders. The Company wants to caution anyone who may be contemplating the purchase of CMKM Diamonds, Inc. stock that it is likely being solicited with promises of unsubstantiated potential future profit. Please see the new High Risk Stock Transaction Waiver that is required to be signed by all parties wishing to be involved in any future transactions REQUESTING CHANGES IN OWNERSHIP of CMKM stock. Chris That is...the SEC said Deli sold until April of '07,,,,,not simply '07 We'll see if these shares are considered low hanging fruit.... ??

Where is the truth from Tyler?
They are supposed to represent us, the shareholders, yes?
Why is it that the real share count of 6.3 trillion shares was not registered into the official company share count, especially since there were boxes of shares NOT counted sitting in the office at Tyler??
Maheu extracted maximum value and yet, the money sits. There is no way we can force the money to be brought to us UNLESS our lawyer and our CEO and our BOD come clean and tell the truth. Ask yourself people where did these people really come from?
People, if Maheu did a great thing for us, since he is gone, it can be undone. Clearly, those who have been entrusted with our money ARE NOT telling the truth. As much as you can say that they are doing it to merely cover up this naked shorting problem, they could also be covering it up so that we have no claim or evidence that we get screwed. Let Tyler waste our time and in the end, the statute of limitations runs out and what do we have? Nothing!
Why has Tyler continually gone after peanuts and the small frye instead of the deep pockets of naked short sellers, market makers, banks and the DTCC? Why won't they at least give us the evidence we need to go after them ourselves by revealing the true share structure and short? Why all the secrecy when they owe us a duty of truth?
When people conceal information from me that owe me the truth, and it serves the interests of a known enemy for them to do so, you will have to forgive me, but I don't trust 'em.
But continue to let those bankers and mafia shills in the rooms and on these boards dissuade you from organizing and demanding the truth from Tyler and from the government. You may one day find that the paltalk administrators, who have mostly all blocked the truth from being discussed in their rooms, and the owners of RB and SI and the rest, are the enemy, or that they have aided the enemy in screwing us.

but we never hear any rumors about uranium or thorium.
