I had been under the impression that Hodges has said all along that (a) it will never go to trial, and that (b) he has the necessary proof, and that (c) the proof in question was something over and above what has already been revealed. If so, at this point, until we hear what he has to say, I don't see how the motion to dismiss is inconsistent with those things. It may just be the cue for presenting that proof. Didn't I read something to the effect that an accountant has proof that the racing car effort was funded by a government agency?

For what it's worth, I was told by someone I trust that if we saw a dismissal, then we have ER. That hodges proof is overwelming and the SEC would stand no chance in court. It's a motion for dismissal, most cases work this way if you have ever been in a lawsuit. Stay strong, I think we will hear something within the weekend. Hi all, this is my first post on the forum. I have been observing this site for many years and felt like now is a good time to say hello. I have a friend who introduced me to this roller coaster ride over 5 years ago. He has worked in the securities industry and he told me the same thing that thematrix is saying here - that a dismissal would happen before we receive our funds. I believe that this is all part of the "plan" and that we are very close to the end of the ride. I am hoping that this Memorial Weekend will be a "memory" for the ages. ;D

This has nothing to do with the actual facts of the case, only the sufficiency of the complaint. The worst case outcome is likely to be a new complaint that addresses the shortcomings of the first, unless the suit is dismissed on the basis of jurisdiction or immunity. None of this has anything to do with whether there is in fact a fund of money for shareholders.

I know one day or one month is not much difference but it is a slight correction. ;D I only posted to let you know what I have been told by my friend. Whether it is true or not, it will not affect the outcome - that is in Al Hodge's hands right now and nothing I say will change that. I want to be part of the forum and post some good statements from time to time, nothing more.

I didnt mean to imply that you specifically arent legitimate... but it simply makes me suspicious when a person who has joined so recently and has never posted - posts to only confirm a rumor. You very well may be sincere in your post... but this happens a lot with a lot of rumors and its easy to fake validity when we are dealing with online forums and screennames... I apologize for any offense I made towards you personally. This stock makes you sort of trust no-one!

We will all have to face each other someday if there is a party, do you want other shareholders to remember you as cool, calm and collected or as one of the pirranha's? Don, IMHO! I'll take being remembered as an idenpendent thinker that doesn't follow the heard like some lost sheep. It is in my nature to always question until I have proof. I have never blindly followed and I never will. I don't know who you are and you don't know who I am. what i do know, is that you have no more of a clue about this than I do. What you are saying and holding on to, is purely your opinion based on stuff yu have have been told by people you don't know. I am a licensed engineer......I know plenty of licensed engineers that have been in their field for 30 years. That sure as h3ll doesn't mean i trust them all to be good at the craft. In fact, a lot of them are terrible. That said, I don't know AH. I don't know his competency level as an attorney. I am not going to take what he says as the truth, just because he said it. So, please don't get all high and mighty on me and sit there and opine about the "plan," as you have no more of an idea about this than I do. So, until AH comes back with a response, we all wait. In the mean time, I am sure everyone has the right to voice their opinion on the motion to dimiss. tyvm Tallyho, You seem to know what I know, can you read my mind too, nice try, I'm not the one asking a billion questions, just sitting back and laughing at those getting all worked up for no reason at all.
