This can't see the inside of a court room or should I say discovery, too dangerous for the security of the markets. The last thing Obama needs is for the market to crash into a deep hole, again.

After sleeping on this overnight, I woke up thinking this might actually worknout for us after all. I don't know why, but I feel that the closer this gets to the court date, the SEC will try everything as a last ditched effort because they know this can't see the courtroom. IMO I think the more negative press we see, the closer we are. Just stay grounded and wait for AH.

I wonder if this has anything to do with the SEC's motion to dismiss:
From the Hodges letter to the President:
"As I have previously stated, I represent some 50,000 shareholders who are to be paid a settlement which consists mainly of monies collected from banks, brokerages, hedge fund corps, market makers, the Depository Trust Corporation/Federal Reserve, and various billionaire “naked-shorter” individuals, as well as some monies due from the SEC for damages."
This was the first I read that the SEC had paid some monies for damages.

I believe I read that as they owe us money or AH believes so "as well as some monies due from the SEC for damages." with DUE being the key word. "

Here are a few reasons why the SEC would move for dismissal: 1.) They represent the Government and the American People. Wasting money representing themselves in a frivolous lawsuit is a no win situation.
2.) There is a problem with the way the suit is filed and it needs to be addressed before moving forward.
3.) They are forcing Attorney Hodges to reveal his evidence (which he is legally obligated to do) supporting his claims because they have no clue as to where he is getting his hairbrained allegations.
4.) And most unlikely...but what everyone wants to believe..They are scared to death and don't want this to see the light of day.
Al Hodges wants this to get dismissed for the following reasons: 1.) He has a shaky list of hearsay witnesses who don't want to be exposed as liars.
2.) He has a reputation to keep intact and doesn't want this to go to trial because if it does, his credibility is shot for life..
3.) He can hide behind the conspiracy theory and perhaps retain more clients and bill more hours while faxing the President's machine and claiming progress.
4.) Because if he had a case with evidence so d*mning, he would go forward expeditiously and force a hearing. He would force the Gov't to release the funds or suffer the consequences. He would be calling the shots and not allowing the SEC to move the date of his conference to schedule a hearing on wether to have a trial or not moved 90 days out..
Hodges has nothing. He's on a fishing expedition with 5 or 6 deluded individuals who have ponied up some cash to retain him. Don't you think it is foolish to throw away good money after bad..
