Here are a few reasons why the SEC would move for dismissal: 1.) They represent the Government and the American People. Wasting money representing themselves in a frivolous lawsuit is a no win situation. 2.) There is a problem with the way the suit is filed and it needs to be addressed before moving forward. 3.) They are forcing Attorney Hodges to reveal his evidence (which he is legally obligated to do) supporting his claims because they have no clue as to where he is getting his hairbrained allegations. 4.) And most unlikely...but what everyone wants to believe..They are scared to death and don't want this to see the light of day. Al Hodges wants this to get dismissed for the following reasons: 1.) He has a shaky list of hearsay witnesses who don't want to be exposed as liars. 2.) He has a reputation to keep intact and doesn't want this to go to trial because if it does, his credibility is shot for life.. 3.) He can hide behind the conspiracy theory and perhaps retain more clients and bill more hours while faxing the President's machine and claiming progress. 4.) Because if he had a case with evidence so d*mning, he would go forward expeditiously and force a hearing. He would force the Gov't to release the funds or suffer the consequences. He would be calling the shots and not allowing the SEC to move the date of his conference to schedule a hearing on wether to have a trial or not moved 90 days out.. Hodges has nothing. He's on a fishing expedition with 5 or 6 deluded individuals who have ponied up some cash to retain him. Don't you think it is foolish to throw away good money after bad.. WHO IN THE HELL ARE YOU??? Don't go too hard on them Manny. This one is just sore because their basketball team fell extremely short of expectations this year and is looking for an outlet to vent their fustrations. ;D

under Rule 12 of the Federal Rules of Criminal Procedure, a party may raise by motion any defense, objection, or request that the court can determine without a trial of the general issue. Before the trial starts, the motions can be based on defects in instituting the prosecution, defects in the indictment or information (which can be challenged at any stage but are generally raised before a trial begins). Pleadings in a federal criminal trial are pleadings in a criminal proceeding are the indictment, the information, and the pleas of not guilty, guilty, and no lo contend ere. A motion under Rule 14 can address the statement of the charges (or individual specifications, see below) or the defendants. In these instances, the motion to dismiss is characterized as a "motion to sever charges or defendants." It is in my opinion that this Motion to dismiss is just a way of letting those involved in this as a way to walk free. It in no way lets them off the hook from paying us. Those from the SEC walk free, and those of us holding stock get paid. We all live happily ever after.

Does anyone know the timeline for this motion to dismiss? Does Al need to have a response in before a certain date so that the judge can make a decision on the motion? I am assuming that something will shake out of the motion. The judge has to approve or deny this motion at some point so that parties could prep for court in July if required. Hoping that we do not have to wait that long Hurricane
