I browsed through it and one thing that I didn't see was anything re: penalties/fines etc. At the very least a penalty MUST be written and enforced and it must be a deterrent. Min penalty: $1.00 ppsThat would certainly satisfy any harmed investors and turn the terrible wrong which is naked short selling into something right which is redemption. IMO of course. zanmiaAdministrator Re: Final Naked Short Selling Antifraud Rule « Reply #3 Today at 3:36am » -------------------------------------------------------------------------------- Hey Wodan, GREAT find!!! mkaykay, I think that Tyler is only concerned with is trying to seize some of the $33 million from Edwards so they can cash out of this crap.
The SEC will do little more than line their own pockets with whatever recovery they manage to get their hands on.
I think the IRS and DOJ have put this on the back burners in light of the bigger issues currently in play (ie, AIG, Fanny Mae, Freddie Mac, etc.)
All we can do is enjoy the day, as nothing will get done anytime soon.

(CMKM) I thought of something today that might just be fun, and I have a reason for it.. Let's start a list of what it was that really made up our minds to invest into this company(CMKM)..!!
One big reasons for me was:
1) The world famous geologist that stated that our 200 kimberlite pipes were a 9 on a number 10 scale, because he didn't believe there was such a thing as a number 10 mine, and the DeBeers mine had a value of $40 billion dollars ..!!!!!
Now just copy and add your reasons..!!

jfarn maybe it's just me, but it seems that you talk out of both sides of your mouth. Some posts show you leaning toward som nonsensical scam put in play by the "Master." while other posts show a more legitimate view that we were just scammed.

With a name like "goodolboy", I should be more tolerant and expect to explain such to you.
a. I have grown tired of waiting b. I think Tyler's actions or lack thereof have been ridiculous c. I think the SEC actions or lack thereof have been ridiculous d. I believe there is much more than meets the eye with CMKM e. I believe we will be compensated and there will be a handsome ROI for certified shareholders f. I will look it to jam it up every entities arse sideways for putting so many in harms way for so long as this shi*t sandwich gets sorted out g. You can't present our story in one manner and not handle it appropriately. I will play along with that direction, but those who wish to pretty up the pig in this manner will have a bunch to explain about.
How's that Good old boy? Are we clear~

jfarn, A through D I'm with you 100% E there is no evidence to suggest such claim F more power to you, jam away... G agreed.
As for the alias I chose to represent myself I'll leave you with this little story:
When asked, my Father used to tell people that he was a truck driver. The only difference between him and all the other truck drivers is that he owned over 3,000 trucks and 27 terminals at the time. We choose certain representations of ourselves for unique and different reasons. I suggest not being so superficial in your identification of such, as it will most likely highlight your ignorance and ineptitude as opposed to some flippant attempt to degrade my socioeconomic status or IQ.

Nice story about your papi, but I really don't give a shi*t where you came from. You want to be a smug little smart #### and suggest double speak, then deal with a little good-hearted ribbing. Ole boy, what do or have you offered? What efforts have you taken to pitch in for our cause? Put down the TV remote, get off your arse, and contribute to the cause. You just might be able to buy a few more trucks when this is all said and done.

I'm looking for a copy of the Al Hodges SEC letter - can anyone help
Here ya go good_ boy, I just happen to have it on hand !! lol lol Subject: File No. S7-08-08 From: AClifton Hodges, Esq. Affiliation: AttorneyMarch 27, 2008
To The SEC Commission and Financial Industry at Large: Naked shorts in the United States = "counterfeit shares." The case of CMKX represents the greatest "counterfeit shares" fraud in the UNITED STATES. CMKM DIAMONDS, INC. suffered THE LARGEST NAKED SHORT IN HISTORY. Trillions of stock shares traded and changed hands UNTIL CMKX revoked itself and had every stock holder pull physical stock certificates out of brokerages, and out of street name, to trap those whom had committed fraud. CMKX is also the LARGEST STOCK CERTIFICATE PULL IN THE HISTORY OF THE UNITED STATES"
Naked short selling is a case of short selling the shares without first arranging a borrow. The Securities Exchange Act of 1934 stipulates a settlement period up to three business days before a stock needs to be delivered, generally referred to as "T+3 delivery". The SECs public position as of the Spring of 2005 was that naked shorting did not exist. With enactment of Regulation SHO, the subsequent elimination of the SHO grandfather exemption, and now the promulgation of this rule, the SEC has finally admitted the error of its ways.
The Depository Trust and Clearing Corporation has also been criticized for its approach to naked short selling. DTCC has been sued with regard to its alleged participation in naked short selling, and the issue of DTCC's possible involvement has been taken up by Senator Robert Bennett and discussed by the NASAA and in articles -- disagreed with by DTCC -- in the Wall Street Journal and Euromoney Magazine. Robert J. Shapiro, former undersecretary of commerce for economic affairs, has, however, found that naked short selling has cost investors $100 billion and driven 1,000 companies into the ground.
Naked shorting is illegal because it allows manipulators a chance to force stock prices down without regard for normal stock supply/demand patterns. It is in fact, institutional fraud further, counterfeiting of securities is a crime of U.S. Constitutional magnitude. This criminal conduct, once asserted by the SEC not to exist, has destroyed many, many companies, lives and opportunities. But now the word is out on naked shorting it must be stopped, and all whom conspired put in jail. This naked shorting fraud rule must be passed - NOW. Sincerely, A. Clifton Hodges HODGES AND ASSOCIATES
