So really, all that matters is ER.. if we get the ER, then we are getting paid.. is that correct. What ever happens after that is all legality.. im just asking..
If thats the case, how do we know when we will get paid and how much?

Just like we have all been saying for 7 years " we'll believe it when the money is in our accounts". That is all Al is saying, because as we all know, if the gov was honest we would not be here having this conversation to begin with. Exactly... this makes me wonder why Bob Maheu would have agreed to let the gov/SEC have full control over our money, without some drop-dead date written into the agreement to ensure no funny business, which obviously did happen. Still, if leverage is needed via the re-file, then might as well drop the hammer on them, not just a weak re-file that will just get dismissed. Imo. Well who knows, but what good is a hammer once you've broken the glass. Sometimes it may be better to have the threat instead of it's use. Once you've used it, and the cat is out of the bag, where is the incentive for the bad guys to release. It opens another can of worms. IMO

If thats the case, how do we know when we will get paid and how much? Haz, If Al tells us of ER, it's over and we will be notified of details by the TA, I'm sure this will payout as a dividend. Don't expect money to come in a day, once notification of ER, I'm guessing it will take a couple weeks or maybe more till money is in shareholders possession. Just a guess. This is one of the main reason I've said money in hand by Oct. Don, IMHO! Don, IMHO!

But, those that stand between the shareholders and distribution are powerful... and in at least some cases, extremely wicked...
Al said that he would communicate with us wen the time came. I'm guessing that means ER expected tomorrow (probably end of day)... AH communicates with us on Friday.
Of course, I AM wearing my rolse-tinted glasses as I type this post...

Stay grounded, I'm hoping for Al to tell us of ER by Friday but still possibly refiling until shareholders have money. Remember this still legally as of today can stretch out 30 more days for the defendants to file in response, will it be needed? I doubt it.
If AL refiles don't sweat it, probably would be for a insurance policy, especially if he notify's us of ER.

A good lawyer has an action plan for any scenario. The great lawyers can anticipate EVERY scenario. This action plan does not surprise me a bit. AH is a great lawyer and we will be paid. Here's to ER announcement tomorrow. D4E + 1

So, ER really isn't fool-proof... from the MTD hearing, it sounded like this ER was part of a trust agreement, allowing the SEC to decide when to release the funds, that the trustees were following their duty by not releasing the funds without permission... now Al is worried about "fake permission"? Well, keep the pressure on, but if the filing doesn't have much meat, won't it just get dismissed, taking away any leverage? IMO. Btw, Sunbeam, thanks for posting the coversation. BETTER TO BE SAFE THEN SORRY... You probably meant, "Better to be safe THAN sorry..."

some more.. very_tired15: My biggest copncern from day one was that Maheu collects, but then they make a deal with corrupt people in government to block the payments so in the end, they can all split it up. I believe we are likely past that point, but maybe not mrsjellis: Would ER mean that the funds are released to the trustee? very_tired15: That is what ER means.
