Karla,
Good afternoon . I am a shareholder in cmkm diamonds and I was wondering if the next scheduled hearing is still on Judge
Selna's calendar for September 16, 2010 as previously agreed at the last hearing.
Also, is this hearing open to the public, if I did wish to attend ?

Do you happen to have a case number? I currently don't have a hearing(other than a trial in the matter of Lass v. Orange
County) on September 16th, but if you can give me a case number and name I will be happy to look up the case and see when the next hearing is.

Currently the only hearing scheduled in this matter is a Scheduling Conference for October 25, 2010 at 11:00 a.m.

A scheduling conference is just what it sounds like, a conference to schedule events that are coming up. For example, should Al file an amended complaint, which I do not believe will happen, the defendants have until the middle of October to respond. The most likely response will be another motion to dismiss. The scheduling conference would then set a briefing schedule and a hearing date for oral argument on the motion to dismiss. Should the defendants choose instead to file an answer in response to the amended complaint, again unlikely, the conference would focus on developing a discovery plan. Most likely the judge would give the parties say 30 days to develop such a plan. It would call for a schedule to submit interrogatories and document requests and a deposition schedule. It might also contain a schedule for dispositive motions (summary judgment) that take place before trial and a trial date. All are subject to change."
